77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to the election of directors for and the authority to issue
1010 bonds of the Johnson County Special Utility District.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Subchapter B, Chapter 7216, Special District
1313 Local Laws Code, is amended by adding Sections 7216.052 and
1414 7216.053 to read as follows:
1515 Sec. 7216.052. DIRECTOR ELIGIBILITY. To be eligible to be
1616 listed on the ballot as a candidate for or to serve as a director, a
1717 person must be:
1818 (1) a qualified voter;
1919 (2) a retail water or sewer service customer of the
2020 district; and
2121 (3) an owner of:
2222 (A) land receiving services from the district; or
2323 (B) a beneficial interest in a trust that owns
2424 land receiving services from the district.
2525 Sec. 7216.053. ELECTION OF DIRECTORS FROM SINGLE-MEMBER
2626 DISTRICTS. (a) The board by rule may provide for the election of
2727 some or all of the directors from single-member districts.
2828 (b) In addition to requirements of Section 7216.052, if the
2929 board provides for the election of some or all of the directors from
3030 single-member districts, to be eligible to be listed on the ballot
3131 as a candidate for or to serve as a director from a single-member
3232 district, a person must be a resident of that district.
3333 SECTION 2. Section 7216.101, Special District Local Laws
3434 Code, is amended to read as follows:
3535 Sec. 7216.101. SPECIAL UTILITY DISTRICT POWERS. The
3636 [Except as specifically limited by Section 7216.102, the] district
3737 has all of the rights, powers, privileges, authority, functions,
3838 and duties provided by general law applicable to a special utility
3939 district created under Section 59, Article XVI, Texas Constitution,
4040 including those provided by Chapters 49 and 65, Water Code.
4141 SECTION 3. Subchapter D, Chapter 7216, Special District
4242 Local Laws Code, is amended by adding Section 7216.152 to read as
4343 follows:
4444 Sec. 7216.152. AUTHORITY TO ISSUE BONDS. (a) The district
4545 has the rights, powers, duties, and obligations of an issuer under
4646 Chapter 1371, Government Code.
4747 (b) Sections 49.181 and 49.182, Water Code, do not apply to
4848 the district.
4949 SECTION 4. Section 7216.102, Special District Local Laws
5050 Code, is repealed.
5151 SECTION 5. (a) The legal notice of the intention to
5252 introduce this Act, setting forth the general substance of this
5353 Act, has been published as provided by law, and the notice and a
5454 copy of this Act have been furnished to all persons, agencies,
5555 officials, or entities to which they are required to be furnished
5656 under Section 59, Article XVI, Texas Constitution, and Chapter 313,
5757 Government Code.
5858 (b) The governor, one of the required recipients, has
5959 submitted the notice and Act to the Texas Commission on
6060 Environmental Quality.
6161 (c) The Texas Commission on Environmental Quality has filed
6262 its recommendations relating to this Act with the governor, the
6363 lieutenant governor, and the speaker of the house of
6464 representatives within the required time.
6565 (d) All requirements of the constitution and laws of this
6666 state and the rules and procedures of the legislature with respect
6767 to the notice, introduction, and passage of this Act are fulfilled
6868 and accomplished.
6969 SECTION 6. This Act takes effect immediately if it receives
7070 a vote of two-thirds of all the members elected to each house, as
7171 provided by Section 39, Article III, Texas Constitution. If this
7272 Act does not receive the vote necessary for immediate effect, this
7373 Act takes effect September 1, 2025.
