77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to the registration of voters at a polling place and
1010 related procedures.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Subchapter A, Chapter 12, Election Code, is
1313 amended by adding Section 12.007 to read as follows:
1414 Sec. 12.007. CERTAIN ELECTION OFFICERS ARE VOTER
1515 REGISTRARS. The registrar shall appoint at least one election
1616 officer serving each polling place for early voting by personal
1717 appearance or on election day as a regular deputy registrar.
1818 SECTION 2. Chapter 63, Election Code, is amended by adding
1919 Section 63.010 to read as follows:
2020 Sec. 63.010. REGISTRATION AT POLLING PLACE; VOTING
2121 PROCEDURES. (a) Other applicable provisions of this code apply to
2222 the conduct of voting and to the registration of voters under this
2323 section to the extent those provisions do not conflict with this
2424 section.
2525 (b) A person who would be eligible to vote in an election
2626 under Section 11.001, but for the requirement to be a registered
2727 voter, shall be accepted for voting in the precinct of the person's
2828 residence if, on the day the person offers to vote, the person:
2929 (1) submits a voter registration application that
3030 complies with Section 13.002 to a voter registrar at the polling
3131 place; and
3232 (2) presents as proof of identification:
3333 (A) a Texas driver's license, including a
3434 temporary license or instruction permit, or personal
3535 identification card issued to the person by the Department of
3636 Public Safety that states the person's current address on the day
3737 the person seeks to vote; or
3838 (B) a utility bill addressed to the person dated
3939 not earlier than the 30th day before the date the person seeks to
4040 vote, and:
4141 (i) a Texas driver's license, including a
4242 temporary license or instruction permit, or personal
4343 identification card issued to the person by the Department of
4444 Public Safety, regardless of whether the address stated on the
4545 license or card is current on the day the person seeks to vote;
4646 (ii) a United States passport issued to the
4747 person; or
4848 (iii) a United States military
4949 identification card that contains the person's photograph.
5050 (c) Persons voting under this section shall be processed
5151 separately at the polling place from persons who are voting under
5252 regular procedures.
5353 (d) The secretary of state shall adopt rules to ensure the
5454 accountability of election officers and to fairly implement this
5555 section.
5656 SECTION 3. Section 85.031(a), Election Code, is amended to
5757 read as follows:
5858 (a) For each person entitled to vote an early voting ballot
5959 by personal appearance or entitled to register at a polling place,
6060 the early voting clerk shall follow the procedure for accepting or
6161 registering a regular voter on election day, with the modifications
6262 necessary for the conduct of early voting.
6363 SECTION 4. The secretary of state shall adopt rules as
6464 required by Section 63.010, Election Code, as added by this Act, not
6565 later than February 1, 2026.
6666 SECTION 5. The changes in law made by this Act apply only to
6767 an election for which early voting by personal appearance begins on
6868 or after February 1, 2026.
6969 SECTION 6. This Act takes effect September 1, 2025.
