88 relating to the creation of the Colmena Ranch Municipal Management
99 District No. 1; granting a limited power of eminent domain;
1010 providing authority to issue bonds; providing authority to impose
1111 assessments and fees.
1212 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1313 SECTION 1. Subtitle C, Title 4, Special District Local Laws
1414 Code, is amended by adding Chapter 4019 to read as follows:
1515 CHAPTER 4019. COLMENA RANCH MUNICIPAL MANAGEMENT DISTRICT NO. 1
1616 SUBCHAPTER A. GENERAL PROVISIONS
1717 Sec. 4019.0101. DEFINITIONS. In this chapter:
1818 (1) "Board" means the district's board of directors.
1919 (2) "County" means Collin County.
2020 (3) "Director" means a board member.
2121 (4) "District" means the Colmena Ranch Municipal
2222 Management District No. 1.
2323 Sec. 4019.0102. NATURE OF DISTRICT. The Colmena Ranch
2424 Municipal Management District No. 1 is a special district created
2525 under Section 59, Article XVI, Texas Constitution.
2626 Sec. 4019.0103. PURPOSE; DECLARATION OF INTENT. (a) The
2727 creation of the district is essential to accomplish the purposes of
2828 Sections 52 and 52-a, Article III, and Section 59, Article XVI,
2929 Texas Constitution, and other public purposes stated in this
3030 chapter.
3131 (b) By creating the district and in authorizing political
3232 subdivisions to contract with the district, the legislature has
3333 established a program to accomplish the public purposes set out in
3434 Section 52-a, Article III, Texas Constitution.
3535 (c) The creation of the district is necessary to promote,
3636 develop, encourage, and maintain employment, commerce,
3737 transportation, housing, tourism, recreation, the arts,
3838 entertainment, economic development, safety, and the public
3939 welfare in the district.
4040 (d) This chapter and the creation of the district may not be
4141 interpreted to relieve the county from providing the level of
4242 services provided as of the effective date of the Act enacting this
4343 chapter to the area in the district. The district is created to
4444 supplement and not to supplant county services provided in the
4545 district.
4646 Sec. 4019.0104. FINDINGS OF BENEFIT AND PUBLIC PURPOSE.
4747 (a) All land and other property included in the district will
4848 benefit from the improvements and services to be provided by the
4949 district under powers conferred by Sections 52 and 52-a, Article
5050 III, and Section 59, Article XVI, Texas Constitution, and other
5151 powers granted under this chapter.
5252 (b) The district is created to serve a public use and
5353 benefit.
5454 (c) The creation of the district is in the public interest
5555 and is essential to further the public purposes of:
5656 (1) developing and diversifying the economy of the
5757 state;
5858 (2) eliminating unemployment and underemployment; and
5959 (3) developing or expanding transportation and
6060 commerce.
6161 (d) The district will:
6262 (1) promote the health, safety, and general welfare of
6363 residents, employers, potential employees, employees, visitors,
6464 and consumers in the district, and of the public;
6565 (2) provide needed funding for the district to
6666 preserve, maintain, and enhance the economic health and vitality of
6767 the district territory as a community and business center;
6868 (3) promote the health, safety, welfare, and enjoyment
6969 of the public by providing pedestrian ways and by landscaping and
7070 developing certain areas in the district, which are necessary for
7171 the restoration, preservation, and enhancement of scenic beauty;
7272 and
7373 (4) provide for water, wastewater, drainage, road, and
7474 recreational facilities for the district.
7575 (e) Pedestrian ways along or across a street, whether at
7676 grade or above or below the surface, and street lighting, street
7777 landscaping, parking, and street art objects are parts of and
7878 necessary components of a street and are considered to be a street
7979 or road improvement.
8080 (f) The district will not act as the agent or
8181 instrumentality of any private interest even though the district
8282 will benefit many private interests as well as the public.
8383 Sec. 4019.0105. INITIAL DISTRICT TERRITORY. (a) The
8484 district is initially composed of the territory described by
8585 Section 2 of the Act enacting this chapter.
8686 (b) The boundaries and field notes contained in Section 2 of
8787 the Act enacting this chapter form a closure. A mistake in the
8888 field notes or in copying the field notes in the legislative process
8989 does not affect the district's:
9090 (1) organization, existence, or validity;
9191 (2) right to issue any type of bonds for the purposes
9292 for which the district is created or to pay the principal of and
9393 interest on the bonds;
9494 (3) right to impose or collect an assessment; or
9595 (4) legality or operation.
9696 Sec. 4019.0106. ELIGIBILITY FOR INCLUSION IN SPECIAL ZONES.
9797 All or any part of the area of the district is eligible to be
9898 included in:
9999 (1) a tax increment reinvestment zone created under
100100 Chapter 311, Tax Code; or
101101 (2) a tax abatement reinvestment zone created under
102102 Chapter 312, Tax Code.
103103 Sec. 4019.0107. APPLICABILITY OF MUNICIPAL MANAGEMENT
104104 DISTRICTS LAW. Except as otherwise provided by this chapter,
105105 Chapter 375, Local Government Code, applies to the district.
106106 Sec. 4019.0108. CONSTRUCTION OF CHAPTER. This chapter
107107 shall be liberally construed in conformity with the findings and
108108 purposes stated in this chapter.
109109 SUBCHAPTER B. BOARD OF DIRECTORS
110110 Sec. 4019.0201. GOVERNING BODY; TERMS. (a) The district is
111111 governed by a board of five elected directors who serve staggered
112112 terms of four years.
113113 (b) Directors are elected in the manner provided by
114114 Subchapter D, Chapter 49, Water Code.
115115 Sec. 4019.0202. COMPENSATION; EXPENSES. (a) The district
116116 may compensate each director in an amount not to exceed $150 for
117117 each board meeting. The total amount of compensation for each
118118 director in one year may not exceed $7,200.
119119 (b) A director is entitled to reimbursement for necessary
120120 and reasonable expenses incurred in carrying out the duties and
121121 responsibilities of the board.
122122 (c) Sections 375.069 and 375.070, Local Government Code, do
123123 not apply to the board.
124124 Sec. 4019.0203. INITIAL DIRECTORS. (a) The initial board
125125 consists of the following directors:

138138 (b) Of the initial directors, the terms of directors
139139 appointed for positions one through three expire June 1, 2027, and
140140 the terms of directors appointed for positions four and five expire
141141 June 1, 2029.
142142 SUBCHAPTER C. POWERS AND DUTIES
143143 Sec. 4019.0301. GENERAL POWERS AND DUTIES. The district
144144 has the powers and duties necessary to accomplish the purposes for
145145 which the district is created.
146146 Sec. 4019.0302. IMPROVEMENT PROJECTS AND SERVICES. (a) The
147147 district, using any money available to the district for the
148148 purpose, may provide, design, construct, acquire, improve,
149149 relocate, operate, maintain, or finance an improvement project or
150150 service authorized under this chapter or Chapter 375, Local
151151 Government Code.
152152 (b) The district may contract with a governmental or private
153153 entity to carry out an action under Subsection (a).
154154 (c) The implementation of a district project or service is a
155155 governmental function or service for the purposes of Chapter 791,
156156 Government Code.
157157 Sec. 4019.0303. NONPROFIT CORPORATION. (a) The board by
158158 resolution may authorize the creation of a nonprofit corporation to
159159 assist and act for the district in implementing a project or
160160 providing a service authorized by this chapter.
161161 (b) The nonprofit corporation:
162162 (1) has each power of and is considered to be a local
163163 government corporation created under Subchapter D, Chapter 431,
164164 Transportation Code; and
165165 (2) may implement any project and provide any service
166166 authorized by this chapter.
167167 (c) The board shall appoint the board of directors of the
168168 nonprofit corporation. The board of directors of the nonprofit
169169 corporation shall serve in the same manner as the board of directors
170170 of a local government corporation created under Subchapter D,
171171 Chapter 431, Transportation Code, except that a board member is not
172172 required to reside in the district.
173173 Sec. 4019.0304. LAW ENFORCEMENT SERVICES. To protect the
174174 public interest, the district may contract with a qualified party,
175175 including the county or a municipality with territory in the
176176 district, to provide law enforcement services in the district for a
177177 fee.
178178 Sec. 4019.0305. MEMBERSHIP IN CHARITABLE ORGANIZATIONS.
179179 The district may join and pay dues to a charitable or nonprofit
180180 organization that performs a service or provides an activity
181181 consistent with the furtherance of a district purpose.
182182 Sec. 4019.0306. ECONOMIC DEVELOPMENT PROGRAMS. (a) The
183183 district may engage in activities that accomplish the economic
184184 development purposes of the district.
185185 (b) The district may establish and provide for the
186186 administration of one or more programs to promote state or local
187187 economic development and to stimulate business and commercial
188188 activity in the district, including programs to:
189189 (1) make loans and grants of public money; and
190190 (2) provide district personnel and services.
191191 (c) The district may create economic development programs
192192 and exercise the economic development powers provided to
193193 municipalities by:
194194 (1) Chapter 380, Local Government Code; and
195195 (2) Subchapter A, Chapter 1509, Government Code.
196196 Sec. 4019.0307. PARKING FACILITIES. (a) The district may
197197 acquire, lease as lessor or lessee, construct, develop, own,
198198 operate, and maintain parking facilities or a system of parking
199199 facilities, including lots, garages, parking terminals, or other
200200 structures or accommodations for parking motor vehicles off the
201201 streets and related appurtenances.
202202 (b) The district's parking facilities serve the public
203203 purposes of the district and are owned, used, and held for a public
204204 purpose even if leased or operated by a private entity for a term of
205205 years.
206206 (c) The district's parking facilities are parts of and
207207 necessary components of a street and are considered to be a street
208208 or road improvement.
209209 (d) The development and operation of the district's parking
210210 facilities may be considered an economic development program.
211211 Sec. 4019.0308. DISBURSEMENTS AND TRANSFERS OF MONEY. The
212212 board by resolution shall establish the number of directors'
213213 signatures and the procedure required for a disbursement or
214214 transfer of district money.
215215 Sec. 4019.0309. ADDING OR EXCLUDING LAND. Except as
216216 provided by Section 4019.0310, the district may add or exclude land
217217 in the manner provided by Subchapter J, Chapter 49, Water Code, or
218218 by Subchapter H, Chapter 54, Water Code.
219219 Sec. 4019.0310. DIVISION OF DISTRICT. (a) The district may
220220 be divided into two or more new districts only if the district has
221221 no outstanding bonded debt.
222222 (b) This chapter applies to any new district created by the
223223 division of the district, and a new district has all the powers and
224224 duties of the district.
225225 (c) Any new district created by the division of the district
226226 may not, at the time the new district is created, contain any land
227227 outside the area described by Section 2 of the Act enacting this
228228 chapter.
229229 (d) The board, on its own motion or on receipt of a petition
230230 signed by the owner or owners of a majority of the assessed value of
231231 the real property in the district, may adopt an order dividing the
232232 district.
233233 (e) An order dividing the district must:
234234 (1) name each new district;
235235 (2) include the metes and bounds description of the
236236 territory of each new district;
237237 (3) appoint initial directors for each new district;
238238 and
239239 (4) provide for the division of assets and liabilities
240240 between or among the new districts.
241241 (f) On or before the 30th day after the date of adoption of
242242 an order dividing the district, the district shall file the order
243243 with the Texas Commission on Environmental Quality and record the
244244 order in the real property records of each county in which the
245245 district is located.
246246 Sec. 4019.0311. CERTAIN RESIDENTIAL PROPERTY NOT EXEMPT.
247247 Section 375.161, Local Government Code, does not apply to the
248248 district.
249249 Sec. 4019.0312. NO AD VALOREM TAX. The district may not
250250 impose an ad valorem tax.
251251 Sec. 4019.0313. EMINENT DOMAIN. The district may exercise
252252 the power of eminent domain in the manner provided by Section
253253 49.222, Water Code.
254254 SUBCHAPTER D. ASSESSMENTS
255255 Sec. 4019.0401. PETITION REQUIRED FOR FINANCING SERVICES
256256 AND IMPROVEMENTS WITH ASSESSMENTS. (a) The board may not finance a
257257 service or improvement project with assessments under this chapter
258258 unless a written petition requesting that service or improvement
259259 has been filed with the board.
260260 (b) A petition filed under Subsection (a) must be signed by
261261 the owners of a majority of the assessed value of real property in
262262 the district subject to assessment according to the most recent
263263 certified tax appraisal roll for the county.
264264 Sec. 4019.0402. ASSESSMENTS; LIENS FOR ASSESSMENTS. (a)
265265 The board by resolution may impose and collect an assessment for any
266266 purpose authorized by this chapter in all or any part of the
267267 district.
268268 (b) An assessment, a reassessment, or an assessment
269269 resulting from an addition to or correction of the assessment roll
270270 by the district, penalties and interest on an assessment or
271271 reassessment, an expense of collection, and reasonable attorney's
272272 fees incurred by the district:
273273 (1) are a first and prior lien against the property
274274 assessed;
275275 (2) are superior to any other lien or claim other than
276276 a lien or claim for county, school district, or municipal ad valorem
277277 taxes; and
278278 (3) are the personal liability of and a charge against
279279 the owners of the property even if the owners are not named in the
280280 assessment proceedings.
281281 (c) The lien is effective from the date of the board's
282282 resolution imposing the assessment until the date the assessment is
283283 paid. The board may enforce the lien in the same manner that a
284284 taxing unit, as that term is defined by Section 1.04, Tax Code, may
285285 enforce an ad valorem tax lien against real property.
286286 (d) The board may make a correction to or deletion from the
287287 assessment roll that does not increase the amount of assessment of
288288 any parcel of land without providing notice and holding a hearing in
289289 the manner required for additional assessments.
290290 SUBCHAPTER E. BONDS
291291 Sec. 4019.0501. AUTHORITY TO BORROW MONEY AND TO ISSUE
292292 BONDS AND OTHER OBLIGATIONS. (a) The district may borrow money on
293293 terms determined by the board.
294294 (b) The district may issue, by public or private sale,
295295 bonds, notes, or other obligations payable wholly or partly from
296296 assessments, impact fees, revenue, contract payments, grants, or
297297 other district money, or any combination of those sources of money,
298298 to pay for any authorized district purpose.
299299 (c) The district may issue, by public or private sale,
300300 bonds, notes, or other obligations payable wholly or partly from
301301 assessments in the manner provided by Subchapter A, Chapter 372,
302302 Local Government Code, if the improvement financed by the
303303 obligation issued under this section will be conveyed to or
304304 operated and maintained by a municipality or other retail utility
305305 provider pursuant to an agreement with the district entered into
306306 before the issuance of the obligation.
307307 Sec. 4019.0502. BONDS SECURED BY REVENUE OR CONTRACT
308308 PAYMENTS. The district may issue, without an election, bonds
309309 secured by:
310310 (1) revenue, including contract revenues; or
311311 (2) contract payments, provided that the requirements
312312 of Section 49.108, Water Code, have been met.
313313 Sec. 4019.0503. CONDITION PRECEDENT TO ISSUING
314314 OBLIGATIONS. (a) The district may not issue bonds, notes, or other
315315 obligations under this subchapter unless the district has entered
316316 into a contract with a municipality, the county, or another entity
317317 that:
318318 (1) provides for adequate supplemental police, fire,
319319 and emergency services for the district; and
320320 (2) is approved by the commissioners court of the
321321 county under Subsection (c).
322322 (b) A contract under Subsection (a) may include a provision
323323 that the contract takes effect only on the approval of the
324324 commissioners court of the county and the voters in the district
325325 voting in an election held for that purpose.
326326 (c) The commissioners court of the county shall review a
327327 contract under Subsection (a) and evaluate the supplemental police,
328328 fire, and emergency services provided for in the contract. If the
329329 commissioners court determines that the contract provides for
330330 adequate services, the commissioners court shall adopt a resolution
331331 stating that the contract has met the requirements of Subsection
332332 (a).
333333 SUBCHAPTER I. DISSOLUTION
334334 Sec. 4019.0901. DISSOLUTION. (a) The board shall dissolve
335335 the district on written petition filed with the board by the owners
336336 of:
337337 (1) at least two-thirds of the assessed value of the
338338 property subject to assessment by the district based on the most
339339 recent certified county property tax rolls; or
340340 (2) at least two-thirds of the surface area of the
341341 district, excluding roads, streets, highways, utility
342342 rights-of-way, other public areas, and other property exempt from
343343 assessment by the district according to the most recent certified
344344 county property tax rolls.
345345 (b) The board by majority vote may dissolve the district at
346346 any time.
347347 (c) The district may not be dissolved by its board under
348348 Subsection (a) or (b) if the district:
349349 (1) has any outstanding bonded indebtedness until that
350350 bonded indebtedness has been repaid or defeased in accordance with
351351 the order or resolution authorizing the issuance of the bonds;
352352 (2) has a contractual obligation to pay money until
353353 that obligation has been fully paid in accordance with the
354354 contract; or
355355 (3) owns, operates, or maintains public works,
356356 facilities, or improvements unless the district contracts with
357357 another person for the ownership, operation, or maintenance of the
358358 public works, facilities, or improvements.
359359 (d) Sections 375.261, 375.262, and 375.264, Local
360360 Government Code, do not apply to the district.
361361 SECTION 2. The Colmena Ranch Municipal Management District
362362 No. 1 initially includes all territory contained in the following
363363 area:

861861 District Local Laws Code, as added by Section 1 of this Act, is
862862 amended by adding Section 4019.0313 to read as follows:
863863 Sec. 4019.0313. NO EMINENT DOMAIN POWER. The district may
864864 not exercise the power of eminent domain.
865865 SECTION 5. This Act takes effect immediately if it receives
866866 a vote of two-thirds of all the members elected to each house, as
867867 provided by Section 39, Article III, Texas Constitution. If this
868868 Act does not receive the vote necessary for immediate effect, this
869869 Act takes effect September 1, 2025.
