77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to the name of and appointment of directors for the
1010 Harris-Montgomery Counties Management District.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. The heading to Chapter 3891, Special District
1313 Local Laws Code, is amended to read as follows:
1414 CHAPTER 3891. SOUTHEAST REGIONAL [HARRIS-MONTGOMERY COUNTIES]
1515 MANAGEMENT DISTRICT
1616 SECTION 2. Section 3891.001(3), Special District Local Laws
1717 Code, is amended to read as follows:
1818 (3) "District" means the Southeast Regional
1919 [Harris-Montgomery Counties] Management District.
2020 SECTION 3. Section 3891.002, Special District Local Laws
2121 Code, is amended to read as follows:
2222 Sec. 3891.002. NATURE OF DISTRICT. The Southeast Regional
2323 [Harris-Montgomery Counties] Management District is a special
2424 district created under Section 59, Article XVI, Texas Constitution.
2525 SECTION 4. Sections 3891.052(a) and (e), Special District
2626 Local Laws Code, are amended to read as follows:
2727 (a) The board shall:
2828 (1) recommend to the Harris County Commissioners Court
2929 persons to serve on a [the] succeeding board; or
3030 (2) petition the Texas Commission on Environmental
3131 Quality to appoint persons to serve on a succeeding board.
3232 (e) If the board petitions the Texas Commission on
3333 Environmental Quality under Subsection (a) for the appointment of
3434 persons to serve on a succeeding board [any provision of
3535 Subsections (a) through (d) is found to be invalid], the commission
3636 [Texas Commission on Environmental Quality] shall appoint the
3737 succeeding board from recommendations of persons to serve on the
3838 succeeding board submitted by the board.
3939 SECTION 5. (a) The legal notice of the intention to
4040 introduce this Act, setting forth the general substance of this
4141 Act, has been published as provided by law, and the notice and a
4242 copy of this Act have been furnished to all persons, agencies,
4343 officials, or entities to which they are required to be furnished
4444 under Section 59, Article XVI, Texas Constitution, and Chapter 313,
4545 Government Code.
4646 (b) The governor, one of the required recipients, has
4747 submitted the notice and Act to the Texas Commission on
4848 Environmental Quality.
4949 (c) The Texas Commission on Environmental Quality has filed
5050 its recommendations relating to this Act with the governor, the
5151 lieutenant governor, and the speaker of the house of
5252 representatives within the required time.
5353 (d) All requirements of the constitution and laws of this
5454 state and the rules and procedures of the legislature with respect
5555 to the notice, introduction, and passage of this Act are fulfilled
5656 and accomplished.
5757 SECTION 6. This Act takes effect immediately if it receives
5858 a vote of two-thirds of all the members elected to each house, as
5959 provided by Section 39, Article III, Texas Constitution. If this
6060 Act does not receive the vote necessary for immediate effect, this
6161 Act takes effect September 1, 2025.
