77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to the purchase of military service credit in the
1010 Employees Retirement System of Texas.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Section 811.001, Government Code, is amended by
1313 adding Subdivisions (16-a), (16-b), and (17-a) to read as follows:
1414 (16-a) "State active duty" has the meaning assigned by
1515 Section 437.001.
1616 (16-b) "State training and other duty" has the meaning
1717 assigned by Section 437.001.
1818 (17-a) "Texas military forces" has the meaning
1919 assigned by Section 437.001.
2020 SECTION 2. Section 813.301(a), Government Code, is amended
2121 to read as follows:
2222 (a) Military service creditable in the retirement system
2323 is:
2424 (1) active federal duty as a member of the armed forces
2525 of the United States; or
2626 (2) state active duty or state training and other duty
2727 as a member of the Texas military forces.
2828 SECTION 3. Section 813.304(b), Government Code, is amended
2929 to read as follows:
3030 (b) The retirement system shall use military service credit
3131 in computing service retirement or nonoccupational disability
3232 retirement benefits of a member of the employee class, regardless
3333 of the amount of service credit the member has in that class [only
3434 if the member has, without military service credit, at least five
3535 years of service credit in that class].
3636 SECTION 4. Section 820.021, Government Code, is amended to
3737 read as follows:
3838 Sec. 820.021. CREDITABLE MILITARY SERVICE; RULES. (a)
3939 Military service creditable in the retirement system under this
4040 subchapter is:
4141 (1) active federal duty as a member of the armed forces
4242 of the United States; or
4343 (2) state active duty or state training and other duty
4444 as a member of the Texas military forces.
4545 (b) The board of trustees shall adopt rules to comply with
4646 the Uniformed Services Employment and Reemployment Rights Act of
4747 1994 (38 U.S.C. Section 4301 et seq.) and otherwise implement this
4848 subchapter, including rules governing how a member subject to this
4949 chapter may establish military service credit under this
5050 subchapter.
5151 SECTION 5. This Act takes effect September 1, 2025.
