12 | 12 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
13 | 13 | SECTION 1. Section 39.151, Utilities Code, is amended by | |
14 | 14 | adding Subsection (g-9) to read as follows: | |
15 | 15 | (g-9) To maintain certification as an independent | |
16 | 16 | organization under this section, an organization must use adaptive | |
17 | 17 | model data analytics software in forecasting power generation | |
18 | 18 | system availability. | |
19 | 19 | SECTION 2. (a) An independent organization certified under | |
20 | 20 | Section 39.151, Utilities Code, by the Public Utility Commission of | |
21 | 21 | Texas before September 1, 2025, shall begin to use adaptive model | |
22 | 22 | data analytics software to comply with Section 39.151, Utilities | |
23 | 23 | Code, as amended by this Act, as soon as practicable, but not later | |
24 | 24 | than September 1, 2026. | |
25 | 25 | (b) After September 1, 2026, the Public Utility Commission | |
26 | 26 | of Texas may decertify an independent organization that does not | |
27 | 27 | use adaptive model data analytics software to comply with Section | |
28 | 28 | 39.151, Utilities Code, as amended by this Act. | |
29 | 29 | SECTION 3. This Act takes effect September 1, 2025. |
