88 AN ACT
99 relating to the use of adaptive model data analytics software by the
1010 independent organization certified to manage the ERCOT power
1111 region.
1212 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1313 SECTION 1. Section 39.151, Utilities Code, is amended by
1414 adding Subsection (g-9) to read as follows:
1515 (g-9) To maintain certification as an independent
1616 organization under this section, an organization must use adaptive
1717 model data analytics software in forecasting power generation
1818 system availability.
1919 SECTION 2. (a) An independent organization certified under
2020 Section 39.151, Utilities Code, by the Public Utility Commission of
2121 Texas before September 1, 2025, shall begin to use adaptive model
2222 data analytics software to comply with Section 39.151, Utilities
2323 Code, as amended by this Act, as soon as practicable, but not later
2424 than September 1, 2026.
2525 (b) After September 1, 2026, the Public Utility Commission
2626 of Texas may decertify an independent organization that does not
2727 use adaptive model data analytics software to comply with Section
2828 39.151, Utilities Code, as amended by this Act.
2929 SECTION 3. This Act takes effect September 1, 2025.
