| 9 | 9 | | relating to proper etiquette during the recitation of the pledge of |

| 10 | 10 | | allegiance to the state flag. |
|---|
| 11 | 11 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 12 | 12 | | SECTION 1. Section 3100.104, Government Code, is amended to |
|---|
| 13 | 13 | | read as follows: |
|---|
| 14 | 14 | | Sec. 3100.104. RECITING PLEDGE. If the pledge to the state |
|---|
| 15 | 15 | | flag is recited, each person who is present and: |
|---|
| 16 | 16 | | (1) not in uniform should: |
|---|
| 17 | 17 | | (A) face the state flag and stand at attention |
|---|
| 18 | 18 | | with the person's right hand: |
|---|
| 19 | 19 | | (i) over the heart; or |
|---|
| 20 | 20 | | (ii) extended toward the flag at waist |
|---|
| 21 | 21 | | level with the elbow bent and the palm facing upward; |
|---|
| 22 | 22 | | (B) if wearing a head covering that is easy to |
|---|
| 23 | 23 | | remove, remove that head covering with the right hand and hold it at |
|---|
| 24 | 24 | | the person's left shoulder, with the person's hand over the heart; |
|---|
| 25 | 25 | | and |
|---|
| 26 | 26 | | (C) recite the pledge; |
|---|
| 27 | 27 | | (2) not in uniform and a member of the armed forces or |
|---|
| 28 | 28 | | a veteran may make the military salute and recite the pledge; or |
|---|
| 29 | 29 | | (3) in uniform should remain silent, face the flag, |
|---|
| 30 | 30 | | and make the military salute. |
|---|
| 31 | 31 | | SECTION 2. This Act takes effect immediately if it receives |
|---|
| 32 | 32 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 33 | 33 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 34 | 34 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 35 | 35 | | Act takes effect September 1, 2025. |
