77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to proper etiquette during the recitation of the pledge of
1010 allegiance to the state flag.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Section 3100.104, Government Code, is amended to
1313 read as follows:
1414 Sec. 3100.104. RECITING PLEDGE. If the pledge to the state
1515 flag is recited, each person who is present and:
1616 (1) not in uniform should:
1717 (A) face the state flag and stand at attention
1818 with the person's right hand:
1919 (i) over the heart; or
2020 (ii) extended toward the flag at waist
2121 level with the elbow bent and the palm facing upward;
2222 (B) if wearing a head covering that is easy to
2323 remove, remove that head covering with the right hand and hold it at
2424 the person's left shoulder, with the person's hand over the heart;
2525 and
2626 (C) recite the pledge;
2727 (2) not in uniform and a member of the armed forces or
2828 a veteran may make the military salute and recite the pledge; or
2929 (3) in uniform should remain silent, face the flag,
3030 and make the military salute.
3131 SECTION 2. This Act takes effect immediately if it receives
3232 a vote of two-thirds of all the members elected to each house, as
3333 provided by Section 39, Article III, Texas Constitution. If this
3434 Act does not receive the vote necessary for immediate effect, this
3535 Act takes effect September 1, 2025.
