77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to the positions designated as exempt from sheriff's
1010 department civil service systems in certain counties.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Section 158.038, Local Government Code, is
1313 amended by amending Subsection (b) and adding Subsection (b-1) to
1414 read as follows:
1515 (b) The sheriff of a county with a population of two [3.3]
1616 million or less may designate as exempt from the civil service
1717 system:
1818 (1) the position of chief deputy;
1919 (2) four positions of major deputy;
2020 (3) one or more positions in the office of
2121 departmental legal counsel; and
2222 (4) additional positions in the department; provided,
2323 however, that the sheriff may not designate as exempt a total of
2424 more than 10 positions.
2525 (b-1) The sheriff of a county with a population of more than
2626 2 million and not more than 3.3 million may designate as exempt from
2727 the civil service system:
2828 (1) the position of chief deputy;
2929 (2) four positions of major deputy;
3030 (3) one or more positions in the office of
3131 departmental legal counsel; and
3232 (4) additional positions in the department; provided,
3333 however, that the sheriff may not designate as exempt a total of
3434 more than 18 positions.
3535 SECTION 2. This Act takes effect September 1, 2025.
