9 | 9 | relating to the positions designated as exempt from sheriff's | |
10 | 10 | department civil service systems in certain counties. | |
11 | 11 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
12 | 12 | SECTION 1. Section 158.038, Local Government Code, is | |
13 | 13 | amended by amending Subsection (b) and adding Subsection (b-1) to | |
14 | 14 | read as follows: | |
15 | 15 | (b) The sheriff of a county with a population of two [3.3] | |
16 | 16 | million or less may designate as exempt from the civil service | |
17 | 17 | system: | |
18 | 18 | (1) the position of chief deputy; | |
19 | 19 | (2) four positions of major deputy; | |
20 | 20 | (3) one or more positions in the office of | |
21 | 21 | departmental legal counsel; and | |
22 | 22 | (4) additional positions in the department; provided, | |
23 | 23 | however, that the sheriff may not designate as exempt a total of | |
24 | 24 | more than 10 positions. | |
25 | 25 | (b-1) The sheriff of a county with a population of more than | |
26 | 26 | 2 million and not more than 3.3 million may designate as exempt from | |
27 | 27 | the civil service system: | |
28 | 28 | (1) the position of chief deputy; | |
29 | 29 | (2) four positions of major deputy; | |
30 | 30 | (3) one or more positions in the office of | |
31 | 31 | departmental legal counsel; and | |
32 | 32 | (4) additional positions in the department; provided, | |
33 | 33 | however, that the sheriff may not designate as exempt a total of | |
34 | 34 | more than 18 positions. | |
35 | 35 | SECTION 2. This Act takes effect September 1, 2025. |
