77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to the provision of financial assistance to survivors of
1010 certain members of the Texas military forces.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Section 615.003, Government Code, is amended to
1313 read as follows:
1414 Sec. 615.003. APPLICABILITY. This chapter applies only to
1515 eligible survivors of the following individuals:
1616 (1) an individual:
1717 (A) elected, appointed, or employed as a peace
1818 officer by the state or a political subdivision of the state under
1919 Article 2A.001, Code of Criminal Procedure, or other law; or
2020 (B) employed as a peace officer by a private
2121 institution of higher education, including a private junior
2222 college, that is located in this state under Section 51.212,
2323 Education Code;
2424 (2) a paid probation officer appointed by the director
2525 of a community supervision and corrections department who has the
2626 duties set out in Section 76.002 and the qualifications set out in
2727 Section 76.005, or who was appointed in accordance with prior law;
2828 (3) a parole officer employed by the Texas Department
2929 of Criminal Justice who has the duties set out in Section 508.001
3030 and the qualifications set out in Section 508.113 or in prior law;
3131 (4) a paid jailer;
3232 (5) a member of an organized police reserve or
3333 auxiliary unit who regularly assists peace officers in enforcing
3434 criminal laws;
3535 (6) a member of the class of employees of the
3636 correctional institutions division formally designated as
3737 custodial personnel under Section 615.006 by the Texas Board of
3838 Criminal Justice or its predecessor in function;
3939 (7) a jailer or guard of a county jail who is appointed
4040 by the sheriff and who:
4141 (A) performs a security, custodial, or
4242 supervisory function over the admittance, confinement, or
4343 discharge of prisoners; and
4444 (B) is certified by the Texas Commission on Law
4545 Enforcement;
4646 (8) a juvenile correctional employee of the Texas
4747 Juvenile Justice Department;
4848 (9) an employee of the Health and Human Services
4949 Commission [Department of Aging and Disability Services or
5050 Department of State Health Services] who:
5151 (A) works at the commission's [department's]
5252 maximum security unit; or
5353 (B) performs on-site services for the Texas
5454 Department of Criminal Justice;
5555 (10) an individual who is employed by the state or a
5656 political or legal subdivision and is subject to certification by
5757 the Texas Commission on Fire Protection;
5858 (11) an individual employed by the state or a
5959 political or legal subdivision whose principal duties are aircraft
6060 crash and rescue fire fighting;
6161 (12) a member of an organized volunteer fire-fighting
6262 unit that:
6363 (A) renders fire-fighting services without
6464 remuneration; and
6565 (B) conducts a minimum of two drills each month,
6666 each two hours long;
6767 (13) an individual who:
6868 (A) performs emergency medical services or
6969 operates an ambulance;
7070 (B) is employed by a political subdivision of the
7171 state or is an emergency medical services volunteer as defined by
7272 Section 773.003, Health and Safety Code; and
7373 (C) is qualified as an emergency care attendant
7474 or at a higher level of training under Section 773.046, 773.047,
7575 773.048, 773.049, or 773.0495, Health and Safety Code;
7676 (14) an individual who is employed or formally
7777 designated as a chaplain for:
7878 (A) an organized volunteer fire-fighting unit or
7979 other fire department of this state or of a political subdivision of
8080 this state;
8181 (B) a law enforcement agency of this state or of a
8282 political subdivision of this state; or
8383 (C) the Texas Department of Criminal Justice;
8484 (15) an individual who is employed by the state or a
8585 political subdivision of the state and who is considered by the
8686 governmental employer to be a trainee for a position otherwise
8787 described by this section;
8888 (16) an individual who is employed by the Department
8989 of Public Safety and, as certified by the director, is:
9090 (A) deployed into the field in direct support of
9191 a law enforcement operation, including patrol, investigative,
9292 search and rescue, crime scene, on-site communications, or special
9393 operations; and
9494 (B) given a special assignment in direct support
9595 of operations relating to organized crime, criminal interdiction,
9696 border security, counterterrorism, intelligence, traffic
9797 enforcement, emergency management, regulatory services, or special
9898 investigations; [or]
9999 (17) an individual who is employed by the Parks and
100100 Wildlife Department and, as certified by the executive director of
101101 the Parks and Wildlife Department, is:
102102 (A) deployed into the field in direct support of
103103 a law enforcement operation, including patrol, investigative,
104104 search and rescue, crime scene, on-site communications, or special
105105 operations; and
106106 (B) given a special assignment in direct support
107107 of operations relating to organized crime, criminal interdiction,
108108 border security, counterterrorism, intelligence, traffic
109109 enforcement, emergency management, regulatory services, or special
110110 investigations; or
111111 (18) a member of the Texas military forces who is on
112112 state active duty, as those terms are defined by Section 437.001.
113113 SECTION 2. The change in law made by this Act relating to
114114 the death of a member of the Texas military forces applies only in
115115 relation to a death that occurs on or after the effective date of
116116 this Act. Matters regarding eligibility, payment, and benefits
117117 under Chapter 615, Government Code, in relation to a death that
118118 occurs before the effective date of this Act are governed by the law
119119 in effect on the date the death occurs, and the former law is
120120 continued in effect for that purpose.
121121 SECTION 3. This Act takes effect September 1, 2025.
