77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to the qualifications for serving as a member of the board
1010 of directors of a municipal utility district.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Section 54.102, Water Code, is amended to read as
1313 follows:
1414 Sec. 54.102. QUALIFICATIONS FOR DIRECTORS. To be qualified
1515 to serve as a director, a person shall:
1616 (1) be at least 18 years old;
1717 (2) be [,] a resident citizen of the State of Texas;
1818 [,] and
1919 (3) [either] own land subject to taxation in the
2020 district [or be a qualified voter within the district].
2121 SECTION 2. The change in law made by this Act does not
2222 affect the entitlement of a member serving immediately before the
2323 effective date of this Act on the board of directors of a district
2424 to which Section 54.102, Water Code, applies to continue to carry
2525 out the board's functions for the remainder of the member's term.
2626 The change in law applies only to a member of the board of directors
2727 of such a district elected or appointed on or after the effective
2828 date of this Act. This Act does not prohibit a person who is a
2929 member of the board of directors of such a district on the effective
3030 date of this Act from being reelected or reappointed to the board if
3131 the person has the qualifications required for a member under
3232 Section 54.102, Water Code, as amended by this Act.
3333 SECTION 3. This Act takes effect September 1, 2025.
