77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to the authority of the Harris County Hospital District to
1010 employ and commission peace officers.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Section 281.057(a), Health and Safety Code, is
1313 amended to read as follows:
1414 (a) The board of the Dallas County Hospital District, the
1515 Tarrant County Hospital District, the Bexar County Hospital
1616 District, [or] the El Paso County Hospital District, or the Harris
1717 County Hospital District may employ and commission peace officers
1818 for the district.
1919 SECTION 2. Article 2A.001, Code of Criminal Procedure, is
2020 amended to read as follows:
2121 Art. 2A.001. PEACE OFFICERS GENERALLY. The following are
2222 peace officers:
2323 (1) a sheriff, a sheriff's deputy, or a reserve deputy
2424 sheriff who holds a permanent peace officer license issued under
2525 Chapter 1701, Occupations Code;
2626 (2) a constable, a deputy constable, or a reserve
2727 deputy constable who holds a permanent peace officer license issued
2828 under Chapter 1701, Occupations Code;
2929 (3) a marshal or police officer of a municipality or a
3030 reserve municipal police officer who holds a permanent peace
3131 officer license issued under Chapter 1701, Occupations Code;
3232 (4) a ranger, officer, or member of the reserve
3333 officer corps commissioned by the Public Safety Commission and the
3434 director of the Department of Public Safety;
3535 (5) an investigator of a district attorney's, criminal
3636 district attorney's, or county attorney's office;
3737 (6) a law enforcement agent of the Texas Alcoholic
3838 Beverage Commission;
3939 (7) a member of an arson investigating unit
4040 commissioned by a municipality, a county, or the state;
4141 (8) an officer commissioned under Section 37.081,
4242 Education Code, or Subchapter E, Chapter 51, Education Code;
4343 (9) an officer commissioned by the Texas Facilities
4444 Commission;
4545 (10) a law enforcement officer commissioned by the
4646 Parks and Wildlife Commission;
4747 (11) an officer commissioned under Chapter 23,
4848 Transportation Code;
4949 (12) a municipal park and recreational patrol officer
5050 or security officer;
5151 (13) a security officer or investigator commissioned
5252 as a peace officer by the comptroller;
5353 (14) an officer commissioned by a water control and
5454 improvement district under Section 49.216, Water Code;
5555 (15) an officer commissioned by a board of trustees
5656 under Chapter 54, Transportation Code;
5757 (16) an investigator commissioned by the Texas Medical
5858 Board;
5959 (17) an officer commissioned by:
6060 (A) the board of managers of the Dallas County
6161 Hospital District, the Tarrant County Hospital District, the Bexar
6262 County Hospital District, [or] the El Paso County Hospital
6363 District, or the Harris County Hospital District under Section
6464 281.057, Health and Safety Code;
6565 (B) the board of directors of the Ector County
6666 Hospital District under Section 1024.117, Special District Local
6767 Laws Code;
6868 (C) the board of directors of the Midland County
6969 Hospital District of Midland County, Texas, under Section 1061.121,
7070 Special District Local Laws Code; or
7171 (D) the board of hospital managers of the Lubbock
7272 County Hospital District of Lubbock County, Texas, under Section
7373 1053.113, Special District Local Laws Code;
7474 (18) a county park ranger commissioned under
7575 Subchapter E, Chapter 351, Local Government Code;
7676 (19) an investigator employed by the Texas Racing
7777 Commission;
7878 (20) an officer commissioned under Chapter 554,
7979 Occupations Code;
8080 (21) an officer commissioned by the governing body of
8181 a metropolitan rapid transit authority under Section 451.108,
8282 Transportation Code, or a regional transportation authority under
8383 Section 452.110, Transportation Code;
8484 (22) an investigator commissioned by the attorney
8585 general under Section 402.009, Government Code;
8686 (23) a security officer or investigator commissioned
8787 as a peace officer under Chapter 466, Government Code;
8888 (24) an officer appointed by an appellate court under
8989 Subchapter F, Chapter 53, Government Code;
9090 (25) an officer commissioned by the state fire marshal
9191 under Chapter 417, Government Code;
9292 (26) an investigator commissioned by the commissioner
9393 of insurance under Section 701.104, Insurance Code;
9494 (27) an apprehension specialist or inspector general
9595 commissioned by the Texas Juvenile Justice Department as an officer
9696 under Section 242.102 or 243.052, Human Resources Code;
9797 (28) an officer appointed by the inspector general of
9898 the Texas Department of Criminal Justice under Section 493.019,
9999 Government Code;
100100 (29) an investigator commissioned by the Texas
101101 Commission on Law Enforcement under Section 1701.160, Occupations
102102 Code;
103103 (30) a fire marshal or any related officer, inspector,
104104 or investigator commissioned by a county under Subchapter B,
105105 Chapter 352, Local Government Code;
106106 (31) a fire marshal or any officer, inspector, or
107107 investigator commissioned by an emergency services district under
108108 Chapter 775, Health and Safety Code;
109109 (32) an officer commissioned by the State Board of
110110 Dental Examiners under Section 254.013, Occupations Code, subject
111111 to the limitations imposed by that section; and
112112 (33) an investigator commissioned by the Texas
113113 Juvenile Justice Department as an officer under Section 221.011,
114114 Human Resources Code.
115115 SECTION 3. This Act takes effect immediately if it receives
116116 a vote of two-thirds of all the members elected to each house, as
117117 provided by Section 39, Article III, Texas Constitution. If this
118118 Act does not receive the vote necessary for immediate effect, this
119119 Act takes effect September 1, 2025.
