| 11 | 11 | SECTION 1. Subchapter D, Chapter 39, Utilities Code, is | |
| 12 | 12 | amended by adding Section 39.171 to read as follows: | |
| 13 | 13 | Sec. 39.171. RESTRICTION ON POWER PURCHASED FOR ERCOT POWER | |
| 14 | 14 | REGION. (a) Notwithstanding any other law, the commission shall | |
| 15 | 15 | prohibit an independent organization certified under Section | |
| 16 | 16 | 39.151 for the ERCOT power region from purchasing more electricity | |
| 17 | 17 | on a daily basis from a facility capable of generating electricity | |
| 18 | 18 | for the ERCOT power region than the facility's base generation | |
| 19 | 19 | capacity. | |
| 20 | 20 | (b) This section does not apply during a peak demand event | |
| 21 | 21 | declared by the commission. | |
| 22 | 22 | SECTION 2. This Act takes effect September 1, 2025. |
