6	8		AN ACT
7	9		relating to the cleaning of a structure used to grow oysters for
8	10		cultivated oyster mariculture.
9	11		BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
10	12		SECTION 1. Subchapter B, Chapter 26, Water Code, is amended
11	13		by adding Section 26.0406 to read as follows:
12	14		Sec. 26.0406. GENERAL PERMITS FOR AQUACULTURE; EXEMPTION
13	15		FOR CLEANING STRUCTURES USED FOR GROWING OYSTERS. (a) A general
14	16		permit for aquaculture issued by the commission must allow the
15	17		holder of a cultivated oyster mariculture permit under Chapter 75,
16	18		Parks and Wildlife Code, to discharge into waters of this state
17	19		waste related to the cleaning of a structure used to grow oysters
18	20		for cultivated oyster mariculture in accordance with Subsection
19	21		(b).
20	22		(b) A cultivated oyster mariculture permit holder cleaning
21	23		a structure as described by Subsection (a):
22	24		(1) may clean the structure only:
23	25		(A) at the location where the permit holder is
24	26		authorized to operate; and
25	27		(B) with water from that location;
26	28		(2) may not alter the water in any way before using the
27	29		water for cleaning, including by adding a soap, chemical, or
28	30		similar substance; and
29	31		(3) must comply with all other permit conditions
30	32		established by the commission.
31	33		(c) In establishing a permit condition described by
32	34		Subsection (b)(3), the commission shall consult with the Parks and
33	35		Wildlife Department.
34	36		SECTION 2. This Act takes effect September 1, 2025.
