88 AN ACT
99 relating to electronic voter registration.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Subchapter A, Chapter 13, Election Code, is
1212 amended by adding Section 13.009 to read as follows:
1313 Sec. 13.009. ELECTRONIC VOTER REGISTRATION. (a) The
1414 secretary of state shall implement a program to allow a person to
1515 complete a voter registration application over the Internet from
1616 the official state Internet website. The secretary of state and the
1717 Department of Public Safety Internet websites must provide a link
1818 to the application on the official state Internet website.
1919 (b) An applicant for electronic voter registration who has a
2020 state-issued driver's license or personal identification card,
2121 regardless of whether the license or card is unexpired, must:
2222 (1) attest to the truth of the information on the
2323 application by affirmatively accepting the information as true; and
2424 (2) affirmatively consent to the use of the signature
2525 on the applicant's driver's license or personal identification card
2626 for voter registration purposes.
2727 (c) An applicant for electronic voter registration who does
2828 not have a state-issued driver's license or personal identification
2929 card must:
3030 (1) attest to the truth of the information on the
3131 application by affirmatively accepting the information as true; and
3232 (2) print a registration application from the Internet
3333 website the applicant is using to register, sign the application,
3434 and mail it to the registrar.
3535 (d) For each application submitted under Subsection (b),
3636 the program must require that a digital copy of the applicant's
3737 signature be obtained from the Department of Public Safety.
3838 (e) For each application submitted under Subsection (c),
3939 the program must provide the applicant with:
4040 (1) a registration application that the applicant can
4141 print from the registration website, sign, and mail to the
4242 registrar as required under Subsection (c)(2); and
4343 (2) information about how the applicant can obtain a
4444 driver's license or personal identification card from the
4545 Department of Public Safety.
4646 (f) An application submitted under this section is
4747 considered for all purposes an application submitted by mail under
4848 this title.
4949 (g) The secretary of state shall adopt rules as necessary to
5050 implement this section, including rules to provide for security
5151 measures to ensure the accuracy and integrity of applications
5252 submitted electronically.
5353 (h) The rules adopted under Subsection (g) must require
5454 that:
5555 (1) the Internet website through which a person may
5656 complete a voter registration application include a description of
5757 the offense described by Section 13.007 in a conspicuous location
5858 on the website near the place where the person begins or submits the
5959 application; and
6060 (2) the state electronic Internet portal project is
6161 used to authenticate the identity of a person who submits an
6262 application electronically under this section.
6363 SECTION 2. This Act takes effect September 1, 2025.
