10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

11 | 11 | | SECTION 1. Subchapter A, Chapter 13, Election Code, is |
---|
12 | 12 | | amended by adding Section 13.009 to read as follows: |
---|
13 | 13 | | Sec. 13.009. ELECTRONIC VOTER REGISTRATION. (a) The |
---|
14 | 14 | | secretary of state shall implement a program to allow a person to |
---|
15 | 15 | | complete a voter registration application over the Internet from |
---|
16 | 16 | | the official state Internet website. The secretary of state and the |
---|
17 | 17 | | Department of Public Safety Internet websites must provide a link |
---|
18 | 18 | | to the application on the official state Internet website. |
---|
19 | 19 | | (b) An applicant for electronic voter registration who has a |
---|
20 | 20 | | state-issued driver's license or personal identification card, |
---|
21 | 21 | | regardless of whether the license or card is unexpired, must: |
---|
22 | 22 | | (1) attest to the truth of the information on the |
---|
23 | 23 | | application by affirmatively accepting the information as true; and |
---|
24 | 24 | | (2) affirmatively consent to the use of the signature |
---|
25 | 25 | | on the applicant's driver's license or personal identification card |
---|
26 | 26 | | for voter registration purposes. |
---|
27 | 27 | | (c) An applicant for electronic voter registration who does |
---|
28 | 28 | | not have a state-issued driver's license or personal identification |
---|
29 | 29 | | card must: |
---|
30 | 30 | | (1) attest to the truth of the information on the |
---|
31 | 31 | | application by affirmatively accepting the information as true; and |
---|
32 | 32 | | (2) print a registration application from the Internet |
---|
33 | 33 | | website the applicant is using to register, sign the application, |
---|
34 | 34 | | and mail it to the registrar. |
---|
35 | 35 | | (d) For each application submitted under Subsection (b), |
---|
36 | 36 | | the program must require that a digital copy of the applicant's |
---|
37 | 37 | | signature be obtained from the Department of Public Safety. |
---|
38 | 38 | | (e) For each application submitted under Subsection (c), |
---|
39 | 39 | | the program must provide the applicant with: |
---|
40 | 40 | | (1) a registration application that the applicant can |
---|
41 | 41 | | print from the registration website, sign, and mail to the |
---|
42 | 42 | | registrar as required under Subsection (c)(2); and |
---|
43 | 43 | | (2) information about how the applicant can obtain a |
---|
44 | 44 | | driver's license or personal identification card from the |
---|
45 | 45 | | Department of Public Safety. |
---|
46 | 46 | | (f) An application submitted under this section is |
---|
47 | 47 | | considered for all purposes an application submitted by mail under |
---|
48 | 48 | | this title. |
---|
49 | 49 | | (g) The secretary of state shall adopt rules as necessary to |
---|
50 | 50 | | implement this section, including rules to provide for security |
---|
51 | 51 | | measures to ensure the accuracy and integrity of applications |
---|
52 | 52 | | submitted electronically. |
---|
53 | 53 | | (h) The rules adopted under Subsection (g) must require |
---|
54 | 54 | | that: |
---|
55 | 55 | | (1) the Internet website through which a person may |
---|
56 | 56 | | complete a voter registration application include a description of |
---|
57 | 57 | | the offense described by Section 13.007 in a conspicuous location |
---|
58 | 58 | | on the website near the place where the person begins or submits the |
---|
59 | 59 | | application; and |
---|
60 | 60 | | (2) the state electronic Internet portal project is |
---|
61 | 61 | | used to authenticate the identity of a person who submits an |
---|
62 | 62 | | application electronically under this section. |
---|
63 | 63 | | SECTION 2. This Act takes effect September 1, 2025. |
