57 A BILL TO BE ENTITLED
68 AN ACT
79 relating to granting limited state law enforcement authority to
810 certain federal law enforcement officers.
911 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1012 SECTION 1. Article 2A.002(a), Code of Criminal Procedure,
1113 is amended to read as follows:
1214 (a) The following criminal investigators of the United
1315 States are not peace officers but have the powers of arrest, search,
1416 and seizure under the laws of this state as to felony offenses only:
1517 (1) a special agent of the Federal Bureau of
1618 Investigation;
1719 (2) a special agent of the Secret Service;
1820 (3) a special agent of United States Immigration and
1921 Customs Enforcement;
2022 (4) a special agent of the Bureau of Alcohol, Tobacco,
2123 Firearms and Explosives;
2224 (5) a special agent of the United States Drug
2325 Enforcement Administration;
2426 (6) an inspector of the United States Postal
2527 Inspection Service;
2628 (7) a special agent of the Criminal Investigation
2729 Division of the Internal Revenue Service;
2830 (8) a civilian special agent of the United States
2931 Naval Criminal Investigative Service;
3032 (9) a marshal or deputy marshal of the United States
3133 Marshals Service;
3234 (10) a special agent of the United States Department
3335 of State, Bureau of Diplomatic Security;
3436 (11) a special agent of the Treasury Inspector General
3537 for Tax Administration;
3638 (12) a special agent of the Office of Inspector
3739 General of the United States Social Security Administration;
3840 (13) a special agent of the Office of Inspector
3941 General of the United States Department of Veterans Affairs;
4042 (14) a special agent of the Office of Inspector
4143 General of the United States Department of Agriculture;
4244 (15) a special agent of the Office of Export
4345 Enforcement of the United States Department of Commerce;
4446 (16) a special agent of the Criminal Investigation
4547 Command of the United States Army;
4648 (17) a special agent of the Office of Special
4749 Investigations of the United States Air Force; [and]
4850 (18) a police officer with the Office of Security and
4951 Law Enforcement of the United States Department of Veterans
5052 Affairs;
5153 (19) a federal air marshal of the Transportation
5254 Security Administration; and
5355 (20) a police officer or detective of the United
5456 States Department of Defense, or any component agency of the United
5557 States Department of Defense.
5658 SECTION 2. This Act takes effect immediately if it receives
5759 a vote of two-thirds of all the members elected to each house, as
5860 provided by Section 39, Article III, Texas Constitution. If this
5961 Act does not receive the vote necessary for immediate effect, this
6062 Act takes effect September 1, 2025.
