77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to the regulation of bleeding control stations in public
1010 schools.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Section 38.030, Education Code, is amended by
1313 amending Subsections (b) and (d) and adding Subsections (b-1),
1414 (b-2), (b-3), and (l) to read as follows:
1515 (b) The protocol required under this section must:
1616 (1) provide for a school district or open-enrollment
1717 charter school to maintain and make available to school employees
1818 and volunteers bleeding control stations, as described by
1919 Subsection (d), for use in the event of a traumatic injury involving
2020 blood loss;
2121 (2) ensure that bleeding control stations are stored
2222 in easily accessible areas of the campus that are selected by the
2323 district's school safety and security committee or the charter
2424 school's governing body;
2525 (3) require that agency-approved training on the use
2626 of a bleeding control station in the event of an injury to another
2727 person be provided to:
2828 (A) each school district peace officer
2929 commissioned under Section 37.081 or school security personnel
3030 employed under that section who provides security services at the
3131 campus;
3232 (B) each school resource officer who provides law
3333 enforcement at the campus; [and]
3434 (C) each armed security officer required to be
3535 present at the campus under Section 37.0814 who is not otherwise
3636 described by Paragraph (A) or (B); and
3737 (D) all other district or school personnel who
3838 may be reasonably expected to use a bleeding control station; and
3939 (4) require the district or charter school to annually
4040 offer instruction on the use of a bleeding control station from a
4141 school resource officer or other appropriate district or school
4242 personnel who has received the training under Subdivision (3) to
4343 students enrolled at the campus in grade four [seven] or higher.
4444 (b-1) A student shall be excused from instruction on the use
4545 of a bleeding control station provided under Subsection (b)(4) on
4646 the written request of a parent or legal guardian without being
4747 subjected to any disciplinary action, academic penalty, or other
4848 sanction.
4949 (b-2) Instruction on the use of a bleeding control station
5050 provided under Subsection (b)(4) to students enrolled at the campus
5151 in grades four, five, and six:
5252 (1) must be appropriate for the student's age and grade
5353 level;
5454 (2) may not use instructional documents that contain
5555 or depict graphic images or graphic descriptions of incidents or
5656 injuries that require bleeding control; and
5757 (3) must be provided with a behavioral health
5858 professional present during the instruction.
5959 (b-3) Instruction on proper chest seal placement may not be
6060 provided to a student.
6161 (d) A bleeding control station required under this section
6262 must contain all of the following required supplies in quantities
6363 determined appropriate by the superintendent of the district or the
6464 director of the school:
6565 (1) tourniquets approved for use in battlefield trauma
6666 care by the armed forces of the United States;
6767 (2) chest seals;
6868 (3) compression bandages;
6969 (4) bleeding control bandages;
7070 (5) space emergency blankets;
7171 (6) latex-free gloves;
7272 (7) markers;
7373 (8) scissors; [and]
7474 (9) instructional documents developed by the American
7575 College of Surgeons or the United States Department of Homeland
7676 Security detailing methods to prevent blood loss following a
7777 traumatic event; and
7878 (10) emergency alerting devices.
7979 (l) In this section:
8080 (1) "Behavioral health professional" means:
8181 (A) a licensed specialist in school psychology
8282 licensed under Chapter 501, Occupations Code;
8383 (B) a licensed professional counselor licensed
8484 under Chapter 503, Occupations Code;
8585 (C) a licensed clinical social worker licensed
8686 under Chapter 505, Occupations Code; or
8787 (D) a school counselor with an appropriate
8888 certificate or permit issued under Subchapter B, Chapter 21.
8989 (2) "Emergency alerting device" means a device
9090 designed to send, once the case containing the device is opened, an
9191 emergency alert that provides continuous information about the
9292 location of the device to preprogrammed recipients, including 9-1-1
9393 call centers, school resource officers, and emergency services
9494 personnel, using multiple forms of communication technology to
9595 ensure connectivity, including cellular telephone technology,
9696 Bluetooth technology, global positioning system technology,
9797 general packet radio service technology, and wireless computer
9898 networking technology.
9999 (3) "Instructional document" means any book, record,
100100 file, or other instrument or material used to provide instruction
101101 on the use of a bleeding control station provided under Subsection
102102 (b)(4).
103103 SECTION 2. This Act applies beginning with the 2025-2026
104104 school year.
105105 SECTION 3. This Act takes effect immediately if it receives
106106 a vote of two-thirds of all the members elected to each house, as
107107 provided by Section 39, Article III, Texas Constitution. If this
108108 Act does not receive the vote necessary for immediate effect, this
109109 Act takes effect September 1, 2025.
