| 11 | 11 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 12 | 12 | | SECTION 1. Chapter 202, Property Code, is amended by adding |
|---|
| 13 | 13 | | Section 202.008 to read as follows: |
|---|
| 14 | 14 | | Sec. 202.008. REGULATION OF CLOTHESLINES. (a) Except as |
|---|
| 15 | 15 | | otherwise provided by this section, a property owners' association |
|---|
| 16 | 16 | | may not include or enforce a provision in a dedicatory instrument |
|---|
| 17 | 17 | | that prohibits or restricts a property owner from installing or |
|---|
| 18 | 18 | | using a clothesline on the owner's property for the purpose of |
|---|
| 19 | 19 | | drying laundry. |
|---|
| 20 | 20 | | (b) A provision that violates Subsection (a) is void. |
|---|
| 21 | 21 | | (c) This section does not prohibit the inclusion or |
|---|
| 22 | 22 | | enforcement of a provision in a dedicatory instrument that: |
|---|
| 23 | 23 | | (1) prohibits a clothesline that: |
|---|
| 24 | 24 | | (A) as adjudicated by a court: |
|---|
| 25 | 25 | | (i) threatens the public health or safety; |
|---|
| 26 | 26 | | or |
|---|
| 27 | 27 | | (ii) violates a law; |
|---|
| 28 | 28 | | (B) is located on property owned or maintained by |
|---|
| 29 | 29 | | the property owners' association; |
|---|
| 30 | 30 | | (C) is located on property owned in common by the |
|---|
| 31 | 31 | | members of the property owners' association; or |
|---|
| 32 | 32 | | (D) is visible above the fence line of a fenced |
|---|
| 33 | 33 | | yard or patio maintained by the property owner; or |
|---|
| 34 | 34 | | (2) prohibits or requires prior approval of the |
|---|
| 35 | 35 | | property owners' association for a clothesline located in or on a |
|---|
| 36 | 36 | | front or side yard or patio maintained by the property owner. |
|---|
| 37 | 37 | | SECTION 2. This Act takes effect September 1, 2025. |
