77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to the purchase and use of contraceptives and access to
1010 contraceptive information.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Chapter 161, Health and Safety Code, is amended
1313 by adding Subchapter Z to read as follows:
1414 SUBCHAPTER Z. CONTRACEPTIVES
1515 Sec. 161.801. DEFINITIONS. In this subchapter:
1616 (1) "Contraceptive" means a drug, device, or other
1717 method of preventing pregnancy that is approved by the United
1818 States Food and Drug Administration.
1919 (2) "Emergency contraceptive" means a drug containing
2020 an elevated dose of hormones that:
2121 (A) is used postcoitally;
2222 (B) prevents pregnancy by preventing
2323 fertilization of an egg or preventing implantation of a fertilized
2424 egg in a uterus; and
2525 (C) is approved by the United States Food and
2626 Drug Administration.
2727 Sec. 161.802. PROHIBITED GOVERNMENTAL RESTRICTIONS RELATED
2828 TO CONTRACEPTIVES. Notwithstanding any other law, a state or local
2929 governmental entity may not prohibit or restrict in any manner the
3030 right of an individual:
3131 (1) to purchase or use a contraceptive, including an
3232 emergency contraceptive; or
3333 (2) to access information on contraceptives,
3434 including emergency contraceptives.
3535 SECTION 2. This Act takes effect September 1, 2025.
