77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to requiring cultural inclusion as part of the social
1010 studies curriculum for public schools.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Section 28.002, Education Code, is amended by
1313 adding Subsection (h-3) to read as follows:
1414 (h-3) In adopting the essential knowledge and skills for the
1515 social studies curriculum for each grade level from kindergarten
1616 through grade 12, the State Board of Education shall adopt
1717 essential knowledge and skills that include the cultural inclusion
1818 curriculum developed under Section 28.0029.
1919 SECTION 2. Subchapter A, Chapter 28, Education Code, is
2020 amended by adding Section 28.0029 to read as follows:
2121 Sec. 28.0029. CULTURAL INCLUSION CURRICULUM. (a) The
2222 State Board of Education shall develop curriculum on cultural
2323 inclusivity that a school district or open-enrollment charter
2424 school shall use in the district's or school's social studies
2525 courses.
2626 (b) The curriculum must encourage:
2727 (1) a student's sense of self;
2828 (2) an acceptance of diversity through the
2929 identification and exploration of differences;
3030 (3) critical thinking about bias through the
3131 identification and exploration of discrimination and stereotypes;
3232 (4) empathy toward others; and
3333 (5) advocating for oneself in the face of bias.
3434 (c) In developing the curriculum under this section, the
3535 State Board of Education shall consult with the agency and
3636 appropriate stakeholders and may create a work group of volunteers
3737 to make recommendations regarding the curriculum.
3838 (d) The State Board of Education, the agency, and
3939 appropriate stakeholders shall enter into a memorandum of
4040 understanding that establishes each entity's respective
4141 responsibilities in developing cultural inclusion curriculum that
4242 reflects the cultural, linguistic, and religious diversity of
4343 society.
4444 (e) Before finalizing the curriculum developed under this
4545 section, the State Board of Education shall provide a reasonable
4646 period for public comment.
4747 (f) Subject to rules adopted by the State Board of
4848 Education, a school district or open-enrollment charter school may
4949 tailor the curriculum developed under this section as appropriate
5050 for the district's or school's community. In tailoring the
5151 instruction, the district or school shall solicit input from the
5252 State Board of Education, the agency, community members, and other
5353 interested individuals or organizations.
5454 SECTION 3. This Act applies beginning with the 2025-2026
5555 school year.
5656 SECTION 4. This Act takes effect immediately if it receives
5757 a vote of two-thirds of all the members elected to each house, as
5858 provided by Section 39, Article III, Texas Constitution. If this
5959 Act does not receive the vote necessary for immediate effect, this
6060 Act takes effect September 1, 2025.
