77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to a deadline for completing services under a family
1010 service plan.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Section 263.102, Family Code, is amended by
1313 amending Subsection (a) and adding Subsection (e-1) to read as
1414 follows:
1515 (a) The service plan must:
1616 (1) be specific;
1717 (2) be in writing in a language that the parents
1818 understand, or made otherwise available;
1919 (3) be prepared by the department in conference with
2020 the child's parents;
2121 (4) state appropriate deadlines;
2222 (5) specify the primary permanency goal and at least
2323 one alternative permanency goal;
2424 (6) state steps that are necessary to:
2525 (A) return the child to the child's home if the
2626 placement is in foster care;
2727 (B) enable the child to remain in the child's
2828 home with the assistance of a service plan if the placement is in
2929 the home under the department's supervision; or
3030 (C) otherwise provide a permanent safe placement
3131 for the child;
3232 (7) state the actions and responsibilities that are
3333 necessary for the child's parents to take to achieve the plan goal
3434 during the period of the service plan and the assistance to be
3535 provided to the parents by the department or other agency toward
3636 meeting that goal;
3737 (8) state any specific skills or knowledge that the
3838 child's parents must acquire or learn, as well as any behavioral
3939 changes the parents must exhibit, to achieve the plan goal;
4040 (9) state the actions and responsibilities that are
4141 necessary for the child's parents to take to ensure that the child
4242 attends school and maintains or improves the child's academic
4343 compliance;
4444 (10) state the name of the person with the department
4545 whom the child's parents may contact for information relating to
4646 the child if other than the person preparing the plan; [and]
4747 (11) prescribe any other term or condition that the
4848 department determines to be necessary to the service plan's
4949 success; and
5050 (12) describe any services the department will provide
5151 under Subsection (e).
5252 (e-1) Services provided by the department under Subsection
5353 (e) must be concluded not later than the 15th business day before
5454 the dismissal date for the suit as provided by Subchapter E.
5555 SECTION 2. The change in law made by this Act applies only
5656 to a service plan that is created on or after the effective date of
5757 this Act. A service plan that is created before the effective date
5858 of this Act is governed by the law in effect on the date the service
5959 plan was created, and the former law is continued in effect for that
6060 purpose.
6161 SECTION 3. This Act takes effect September 1, 2025.
