6	8		AN ACT
7	9		relating to the secretary of state posting on the secretary of
8	10		state's Internet website databases containing certain information
9	11		about elections.
10	12		BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
11	13		SECTION 1. Section 4.003, Election Code, is amended by
12	14		amending Subsection (e) and adding Subsection (e-1) to read as
13	15		follows:
14	16		(e) The authority responsible for giving notice of the
15	17		election shall deliver:
16	18		(1) to the secretary of state a copy of the notice of a
17	19		consolidated precinct required by Subsection (b) not later than the
18	20		date of the election; and
19	21		(2) in January of each year information on an election
20	22		for a partisan office, the office of mayor, or a position on the
21	23		governing body of a city or board of trustees of an independent
22	24		school district for the secretary of state's database of election
23	25		information under Section 31.023 in an electronic format as
24	26		follows:
25	27		(A) if the authority is a county or political
26	28		party, as required by the secretary of state; or
27	29		(B) if the authority is a city or school
28	30		district, to the county in which the authority is located.
29	31		(e-1) A county receiving information under Subsection
30	32		(e)(2)(B) shall forward the information to the secretary of state.
31	33		SECTION 2. Subchapter A, Chapter 31, Election Code, is
32	34		amended by adding Sections 31.023 and 31.024 to read as follows:
33	35		Sec. 31.023. INTERNET DATABASE OF ELECTION INFORMATION.
34	36		(a) The secretary of state shall post on the secretary of state's
35	37		public Internet website a database containing information on each
36	38		election for a partisan office, the office of mayor, or a position
37	39		on the governing body of a city or board of trustees of an
38	40		independent school district provided under Sections 4.003(e) and
39	41		(e-1). The database must include the following information:
40	42		(1) the name of the authority;
41	43		(2) each office to be filled at the election;
42	44		(3) whether the office is elected at large or by
43	45		district;
44	46		(4) the duration of the term of office; and
45	47		(5) the dates of the preceding and next election for
46	48		the office.
47	49		(b) The secretary of state shall adopt rules as necessary to
48	50		implement this section.
49	51		Sec. 31.024. INTERNET DATABASE FOR INCUMBENTS AND
50	52		CANDIDATES. (a) The secretary of state shall post on the secretary
51	53		of state's public Internet website a database containing
52	54		information about each holder of and candidate for any partisan
53	55		elected office, office of mayor, or position on the governing body
54	56		of a city or a board of trustees of an independent school district
55	57		in this state.
56	58		(b) The database must include the following information
57	59		about a holder of a partisan elected office, the office of mayor, or
58	60		a position on the governing body of a city or board of trustees of an
59	61		independent school district:
60	62		(1) name;
61	63		(2) office title, including any district, place, or
62	64		position and a notation that the person is an incumbent;
63	65		(3) if the office is elected at large or by district;
64	66		(4) date of the previous and next election for the
65	67		office;
66	68		(5) public mailing address;
67	69		(6) public telephone number, if available; and
68	70		(7) public e-mail address, if available.
69	71		(c) The database must include the following information
70	72		about a candidate for a partisan elected office, the office of
71	73		mayor, or a position on the governing body of a city or board of
72	74		trustees of an independent school district:
73	75		(1) name;
74	76		(2) office sought, including any district, place, or
75	77		position;
76	78		(3) if the office is elected at large or by district;
77	79		(4) date of the election;
78	80		(5) public mailing address;
79	81		(6) public telephone number, if available;
80	82		(7) public e-mail address, if available; and
81	83		(8) if the candidate has filed as a write-in
82	84		candidate.
83	85		(d) The county with whom a declaration of candidacy is
84	86		filed, a state or county chair of a political party, or the
85	87		presiding officer of a political party's convention shall provide
86	88		information about a candidate or officeholder to the secretary of
87	89		state. A political subdivision shall provide information about a
88	90		candidate or officeholder to the county in which the political
89	91		subdivision is located and the county shall forward that
90	92		information to the secretary of state.
91	93		(e) The secretary of state shall make the name, office, and
92	94		party affiliation of the holder of a partisan elected office, the
93	95		office of mayor, or a position on the governing body of a city or
94	96		board of trustees of an independent school district available on
95	97		the secretary of state's public Internet website for as long as the
96	98		person holds that office.
97	99		(f) The secretary of state shall adopt rules as necessary to
98	100		implement this section.
99	101		SECTION 3. Section 141.032, Election Code, is amended by
100	102		adding Subsection (h) to read as follows:
101	103		(h) A county or political party with whom an application is
102	104		filed shall provide the secretary of state with the candidate's
103	105		information required for the secretary of state's public Internet
104	106		website under Section 31.024. A political subdivision with whom an
105	107		application is filed shall provide the candidate's information to
106	108		the county in which the political subdivision is located, and the
107	109		county shall forward the candidate's information to the secretary
108	110		of state.
109	111		SECTION 4. This Act takes effect September 1, 2025.
