57 A BILL TO BE ENTITLED
68 AN ACT
79 relating to the secretary of state posting on the secretary of
810 state's Internet website databases containing certain information
911 about elections.
1012 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1113 SECTION 1. Section 4.003, Election Code, is amended by
1214 amending Subsection (e) and adding Subsection (e-1) to read as
1315 follows:
1416 (e) The authority responsible for giving notice of the
1517 election shall deliver:
1618 (1) to the secretary of state a copy of the notice of a
1719 consolidated precinct required by Subsection (b) not later than the
1820 date of the election; and
1921 (2) in January of each year information on an election
2022 for a partisan office, the office of mayor, or a position on the
2123 governing body of a city or board of trustees of an independent
2224 school district for the secretary of state's database of election
2325 information under Section 31.023 in an electronic format as
2426 follows:
2527 (A) if the authority is a county or political
2628 party, as required by the secretary of state; or
2729 (B) if the authority is a city or school
2830 district, to the county in which the authority is located.
2931 (e-1) A county receiving information under Subsection
3032 (e)(2)(B) shall forward the information to the secretary of state.
3133 SECTION 2. Subchapter A, Chapter 31, Election Code, is
3234 amended by adding Sections 31.023 and 31.024 to read as follows:
3335 Sec. 31.023. INTERNET DATABASE OF ELECTION INFORMATION.
3436 (a) The secretary of state shall post on the secretary of state's
3537 public Internet website a database containing information on each
3638 election for a partisan office, the office of mayor, or a position
3739 on the governing body of a city or board of trustees of an
3840 independent school district provided under Sections 4.003(e) and
3941 (e-1). The database must include the following information:
4042 (1) the name of the authority;
4143 (2) each office to be filled at the election;
4244 (3) whether the office is elected at large or by
4345 district;
4446 (4) the duration of the term of office; and
4547 (5) the dates of the preceding and next election for
4648 the office.
4749 (b) The secretary of state shall adopt rules as necessary to
4850 implement this section.
4951 Sec. 31.024. INTERNET DATABASE FOR INCUMBENTS AND
5052 CANDIDATES. (a) The secretary of state shall post on the secretary
5153 of state's public Internet website a database containing
5254 information about each holder of and candidate for any partisan
5355 elected office, office of mayor, or position on the governing body
5456 of a city or a board of trustees of an independent school district
5557 in this state.
5658 (b) The database must include the following information
5759 about a holder of a partisan elected office, the office of mayor, or
5860 a position on the governing body of a city or board of trustees of an
5961 independent school district:
6062 (1) name;
6163 (2) office title, including any district, place, or
6264 position and a notation that the person is an incumbent;
6365 (3) if the office is elected at large or by district;
6466 (4) date of the previous and next election for the
6567 office;
6668 (5) public mailing address;
6769 (6) public telephone number, if available; and
6870 (7) public e-mail address, if available.
6971 (c) The database must include the following information
7072 about a candidate for a partisan elected office, the office of
7173 mayor, or a position on the governing body of a city or board of
7274 trustees of an independent school district:
7375 (1) name;
7476 (2) office sought, including any district, place, or
7577 position;
7678 (3) if the office is elected at large or by district;
7779 (4) date of the election;
7880 (5) public mailing address;
7981 (6) public telephone number, if available;
8082 (7) public e-mail address, if available; and
8183 (8) if the candidate has filed as a write-in
8284 candidate.
8385 (d) The county with whom a declaration of candidacy is
8486 filed, a state or county chair of a political party, or the
8587 presiding officer of a political party's convention shall provide
8688 information about a candidate or officeholder to the secretary of
8789 state. A political subdivision shall provide information about a
8890 candidate or officeholder to the county in which the political
8991 subdivision is located and the county shall forward that
9092 information to the secretary of state.
9193 (e) The secretary of state shall make the name, office, and
9294 party affiliation of the holder of a partisan elected office, the
9395 office of mayor, or a position on the governing body of a city or
9496 board of trustees of an independent school district available on
9597 the secretary of state's public Internet website for as long as the
9698 person holds that office.
9799 (f) The secretary of state shall adopt rules as necessary to
98100 implement this section.
99101 SECTION 3. Section 141.032, Election Code, is amended by
100102 adding Subsection (h) to read as follows:
101103 (h) A county or political party with whom an application is
102104 filed shall provide the secretary of state with the candidate's
103105 information required for the secretary of state's public Internet
104106 website under Section 31.024. A political subdivision with whom an
105107 application is filed shall provide the candidate's information to
106108 the county in which the political subdivision is located, and the
107109 county shall forward the candidate's information to the secretary
108110 of state.
109111 SECTION 4. This Act takes effect September 1, 2025.
