77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to a law enforcement agency policy regarding drug and
1010 alcohol testing of peace officers involved in certain injuries or
1111 deaths.
1212 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1313 SECTION 1. Subchapter B, Chapter 2A, Code of Criminal
1414 Procedure, is amended by adding Article 2A.067 to read as follows:
1515 Art. 2A.067. LAW ENFORCEMENT POLICY ON DRUG AND ALCOHOL
1616 TESTING AFTER OFFICER-INVOLVED INJURIES OR DEATHS. (a) In this
1717 article:
1818 (1) "Law enforcement agency" has the meaning assigned
1919 by Article 2B.0053.
2020 (2) "Officer-involved injury or death" means any
2121 serious bodily injury or death caused by a peace officer regardless
2222 of whether the peace officer was on duty at the time the injury or
2323 death occurred.
2424 (3) "Serious bodily injury" has the meaning assigned
2525 by Section 1.07, Penal Code.
2626 (b) This article applies only to a law enforcement agency
2727 operating in a county with a population of more than 500,000.
2828 (c) Each law enforcement agency to which this article
2929 applies shall adopt a detailed written policy requiring a peace
3030 officer who causes an officer-involved injury or death to submit to
3131 the agency, not later than six hours after the officer-involved
3232 injury or death, a specimen of the officer's blood, urine, or other
3333 bodily substance to assess:
3434 (1) the officer's blood alcohol content; and
3535 (2) whether there is a controlled substance in the
3636 officer's body.
3737 SECTION 2. Each law enforcement agency to which Article
3838 2A.067, Code of Criminal Procedure, as added by this Act, applies
3939 shall adopt the policy required by that article as soon as
4040 practicable after the effective date of this Act.
4141 SECTION 3. This Act takes effect September 1, 2025.
