| 12 | 12 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 13 | 13 | | SECTION 1. Subchapter B, Chapter 2A, Code of Criminal |
|---|
| 14 | 14 | | Procedure, is amended by adding Article 2A.067 to read as follows: |
|---|
| 15 | 15 | | Art. 2A.067. LAW ENFORCEMENT POLICY ON DRUG AND ALCOHOL |
|---|
| 16 | 16 | | TESTING AFTER OFFICER-INVOLVED INJURIES OR DEATHS. (a) In this |
|---|
| 17 | 17 | | article: |
|---|
| 18 | 18 | | (1) "Law enforcement agency" has the meaning assigned |
|---|
| 19 | 19 | | by Article 2B.0053. |
|---|
| 20 | 20 | | (2) "Officer-involved injury or death" means any |
|---|
| 21 | 21 | | serious bodily injury or death caused by a peace officer regardless |
|---|
| 22 | 22 | | of whether the peace officer was on duty at the time the injury or |
|---|
| 23 | 23 | | death occurred. |
|---|
| 24 | 24 | | (3) "Serious bodily injury" has the meaning assigned |
|---|
| 25 | 25 | | by Section 1.07, Penal Code. |
|---|
| 26 | 26 | | (b) This article applies only to a law enforcement agency |
|---|
| 27 | 27 | | operating in a county with a population of more than 500,000. |
|---|
| 28 | 28 | | (c) Each law enforcement agency to which this article |
|---|
| 29 | 29 | | applies shall adopt a detailed written policy requiring a peace |
|---|
| 30 | 30 | | officer who causes an officer-involved injury or death to submit to |
|---|
| 31 | 31 | | the agency, not later than six hours after the officer-involved |
|---|
| 32 | 32 | | injury or death, a specimen of the officer's blood, urine, or other |
|---|
| 33 | 33 | | bodily substance to assess: |
|---|
| 34 | 34 | | (1) the officer's blood alcohol content; and |
|---|
| 35 | 35 | | (2) whether there is a controlled substance in the |
|---|
| 36 | 36 | | officer's body. |
|---|
| 37 | 37 | | SECTION 2. Each law enforcement agency to which Article |
|---|
| 38 | 38 | | 2A.067, Code of Criminal Procedure, as added by this Act, applies |
|---|
| 39 | 39 | | shall adopt the policy required by that article as soon as |
|---|
| 40 | 40 | | practicable after the effective date of this Act. |
|---|
| 41 | 41 | | SECTION 3. This Act takes effect September 1, 2025. |
