77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to required disclosures on certain political advertising
1010 by political committees; providing a civil penalty.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Chapter 255, Election Code, is amended by adding
1313 Section 255.009 to read as follows:
1414 Sec. 255.009. REQUIRED DISCLOSURE ON CERTAIN POLITICAL
1515 ADVERTISING BY POLITICAL COMMITTEES; CIVIL PENALTY. (a) A
1616 political committee may not publish, distribute, or broadcast
1717 political advertising supporting a slate of five or more candidates
1818 who made a contribution to the political committee for the purpose
1919 of obtaining that support unless the political advertising includes
2020 a disclosure statement indicating:
2121 (1) the full name of each candidate the political
2222 advertising supports;
2323 (2) that the candidates made a contribution to the
2424 political committee for the purpose of obtaining that support; and
2525 (3) if any of the candidates created the political
2626 committee, the full name of each candidate who created the
2727 political committee.
2828 (b) A political committee that violates this section is
2929 liable to this state for a civil penalty in an amount determined by
3030 the commission not to exceed $4,000.
3131 SECTION 2. Section 255.009, Election Code, as added by this
3232 Act, applies only to political advertising that is published,
3333 distributed, or broadcast by a political committee on or after the
3434 effective date of this Act
3535 SECTION 3. This Act takes effect September 1, 2025.
