| 12 | 12 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
| 13 | 13 | SECTION 1. Subchapter A, Chapter 2165, Government Code, is | |
| 14 | 14 | amended by adding Section 2165.010 to read as follows: | |
| 15 | 15 | Sec. 2165.010. TOBACCO PROHIBITION INSIDE OR ON GROUNDS OF | |
| 16 | 16 | CERTAIN STATE BUILDINGS; CRIMINAL OFFENSE. (a) In this section, | |
| 17 | 17 | "state agency" means a department, commission, board, office, or | |
| 18 | 18 | other agency in the executive, legislative, or judicial branch of | |
| 19 | 19 | state government created by the state constitution or a state | |
| 20 | 20 | statute. The term does not include a university system or an | |
| 21 | 21 | institution of higher education as defined by Section 61.003, | |
| 22 | 22 | Education Code. | |
| 23 | 23 | (b) A person commits an offense if the person is in | |
| 24 | 24 | possession of a burning tobacco product or smokes tobacco inside or | |
| 25 | 25 | on the grounds of a state-owned building in which a state agency's | |
| 26 | 26 | office is located. | |
| 27 | 27 | (c) An offense under Subsection (b) is a Class C misdemeanor | |
| 28 | 28 | punishable by a fine not to exceed $50. | |
| 29 | 29 | SECTION 2. This Act takes effect September 1, 2025. |
