77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to the use of certain facilities of a building being used
1010 as a polling place or early voting polling place.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Section 61.003, Election Code, is amended by
1313 adding Subsection (a-2) to read as follows:
1414 (a-2) The secretary of state shall adopt rules requiring the
1515 entity that owns or controls a building being used as a polling
1616 place to permit a person electioneering on the building's premises
1717 outside of the area described in Subsection (a) to use the
1818 facilities of the buildings otherwise available to voters or
1919 election officials, including bathrooms. The rules must provide
2020 that the person:
2121 (1) may not bring political signs or literature inside
2222 the area described in Subsection (a);
2323 (2) must cover or remove any political logos or
2424 messaging before entering the area described in Subsection (a); and
2525 (3) must meet any other requirements determined by the
2626 secretary of state to be necessary to ensure the person complies
2727 with Subsection (a).
2828 SECTION 2. Section 85.036, Election Code, is amended by
2929 adding Subsection (c-1) to read as follows:
3030 (c-1) The secretary of state shall adopt rules requiring the
3131 entity that owns or controls a building being used as an early
3232 voting polling place to permit a person electioneering on the
3333 building's premises outside of the area described in Subsection (a)
3434 to use the facilities of the buildings otherwise available to
3535 voters or election officials, including bathrooms. The rules must
3636 provide that the person:
3737 (1) may not bring political signs or literature inside
3838 the area described in Subsection (a);
3939 (2) must cover or remove any political logos or
4040 messaging before entering the area described in Subsection (a); and
4141 (3) must meet any other requirements determined by the
4242 secretary of state to be necessary to ensure the person complies
4343 with Subsection (a).
4444 SECTION 3. This Act takes effect September 1, 2025.
