77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to a manufacturer's disclosure of cosmetic ingredients;
1010 authorizing an administrative penalty.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Subchapter F, Chapter 431, Health and Safety
1313 Code, is amended by adding Section 431.143 to read as follows:
1414 Sec. 431.143. MANUFACTURER DISCLOSURE. (a) A manufacturer
1515 selling a cosmetic in this state shall disclose on the
1616 manufacturer's Internet website:
1717 (1) a list of each ingredient in the cosmetic,
1818 including a fragrance, flavor, and color additive, in order of
1919 predominance except the ingredients with a concentration of less
2020 than one percent may be listed in any order for purposes of
2121 protecting a trade secret; and
2222 (2) the chemical abstract service number for each
2323 listed ingredient.
2424 (b) A manufacturer is not required to list the concentration
2525 of each ingredient in a cosmetic under Subsection (a).
2626 SECTION 2. Section 431.054(a), Health and Safety Code, is
2727 amended to read as follows:
2828 (a) The department may assess an administrative penalty
2929 against a person who violates Subchapter B, Section 431.143, or an
3030 order adopted or registration issued under this chapter.
3131 SECTION 3. This Act takes effect September 1, 2025.
