| 11 | 11 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 12 | 12 | | SECTION 1. Subchapter F, Chapter 431, Health and Safety |
|---|
| 13 | 13 | | Code, is amended by adding Section 431.143 to read as follows: |
|---|
| 14 | 14 | | Sec. 431.143. MANUFACTURER DISCLOSURE. (a) A manufacturer |
|---|
| 15 | 15 | | selling a cosmetic in this state shall disclose on the |
|---|
| 16 | 16 | | manufacturer's Internet website: |
|---|
| 17 | 17 | | (1) a list of each ingredient in the cosmetic, |
|---|
| 18 | 18 | | including a fragrance, flavor, and color additive, in order of |
|---|
| 19 | 19 | | predominance except the ingredients with a concentration of less |
|---|
| 20 | 20 | | than one percent may be listed in any order for purposes of |
|---|
| 21 | 21 | | protecting a trade secret; and |
|---|
| 22 | 22 | | (2) the chemical abstract service number for each |
|---|
| 23 | 23 | | listed ingredient. |
|---|
| 24 | 24 | | (b) A manufacturer is not required to list the concentration |
|---|
| 25 | 25 | | of each ingredient in a cosmetic under Subsection (a). |
|---|
| 26 | 26 | | SECTION 2. Section 431.054(a), Health and Safety Code, is |
|---|
| 27 | 27 | | amended to read as follows: |
|---|
| 28 | 28 | | (a) The department may assess an administrative penalty |
|---|
| 29 | 29 | | against a person who violates Subchapter B, Section 431.143, or an |
|---|
| 30 | 30 | | order adopted or registration issued under this chapter. |
|---|
| 31 | 31 | | SECTION 3. This Act takes effect September 1, 2025. |
