10 | 10 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
11 | 11 | SECTION 1. Subchapter L, Chapter 264, Family Code, is | |
12 | 12 | amended by adding Section 264.908 to read as follows: | |
13 | 13 | Sec. 264.908. USE OF PARENTAL CHILD SAFETY PLACEMENTS. (a) | |
14 | 14 | Notwithstanding other law, the department shall use a parental | |
15 | 15 | child safety placement in each case in which the department | |
16 | 16 | determines it is appropriate. | |
17 | 17 | (b) If the department determines that a parental child | |
18 | 18 | safety placement is not appropriate, the department shall: | |
19 | 19 | (1) record in writing in the child's case file the | |
20 | 20 | reasons the department determined a parental child safety placement | |
21 | 21 | was not appropriate; and | |
22 | 22 | (2) notify the child's state representative and state | |
23 | 23 | senator about the department's decision and the reasons the | |
24 | 24 | department determined a parental child safety placement was not | |
25 | 25 | appropriate. | |
26 | 26 | SECTION 2. This Act takes effect September 1, 2025. |
