77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to a manufacturer's disclosure of ingredients and toxic
1010 metals in lipstick and lip gloss.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Subchapter F, Chapter 431, Health and Safety
1313 Code, is amended by adding Section 431.143 to read as follows:
1414 Sec. 431.143. MANUFACTURER DISCLOSURES: LIPSTICK AND LIP
1515 GLOSS COSMETIC. The executive commissioner by rule shall require a
1616 manufacturer that sells a lipstick or lip gloss cosmetic to
1717 disclose on the manufacturer's Internet website and the cosmetic
1818 label:
1919 (1) any toxic metal, including lead, chromium,
2020 cadmium, aluminum, and manganese, in the cosmetic, regardless of
2121 whether the concentration of the metal in the cosmetic is less than
2222 one percent; and
2323 (2) a list of each ingredient in the cosmetic,
2424 including a fragrance, flavor, and color additive.
2525 SECTION 2. As soon as practicable after the effective date
2626 of this Act, the executive commissioner of the Health and Human
2727 Services Commission shall adopt rules necessary to implement
2828 Section 431.143, Health and Safety Code, as added by this Act.
2929 SECTION 3. This Act takes effect September 1, 2025.
