77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to the permissible uses of the bilingual education
1010 allotment provided under the Foundation School Program.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Section 48.105(b), Education Code, is amended to
1313 read as follows:
1414 (b) At least 55 percent of the funds allocated under this
1515 section must be used in providing bilingual education or special
1616 language programs under Subchapter B, Chapter 29. A district's
1717 bilingual education or special language allocation may be used only
1818 for program and student evaluation, instructional materials and
1919 equipment, staff development, supplemental staff expenses,
2020 salaries [salary supplements] for teachers, incremental costs
2121 associated with providing smaller class sizes, and other supplies
2222 required for quality instruction.
2323 SECTION 2. This Act applies beginning with the 2025-2026
2424 school year.
2525 SECTION 3. This Act takes effect immediately if it receives
2626 a vote of two-thirds of all the members elected to each house, as
2727 provided by Section 39, Article III, Texas Constitution. If this
2828 Act does not receive the vote necessary for immediate effect, this
2929 Act takes effect September 1, 2025.
