88 relating to the creation of the Puerto Verde Port Authority
99 District; providing authority to issue bonds; providing authority
1010 to impose assessments, fees, and taxes; granting a limited power of
1111 eminent domain.
1212 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1313 SECTION 1. Subtitle C, Title 4, Special District Local Laws
1414 Code, is amended by adding Chapter 4011 to read as follows:
1515 CHAPTER 4011. PUERTO VERDE PORT AUTHORITY DISTRICT
1616 SUBCHAPTER A. GENERAL PROVISIONS
1717 Sec. 4011.0101. DEFINITIONS. In this chapter:
1818 (1) "Board" means the district's board of directors.
1919 (2) "County" means Maverick County.
2020 (3) "Director" means a board member.
2121 (4) "District" means the Puerto Verde Port Authority
2222 District.
2323 (5) "Rail facilities" includes all real and personal
2424 property owned or held by the district for railroad purposes,
2525 including land, interests in land, structures, easements, rail
2626 lines, stations, platforms, rolling stock, garages, equipment, and
2727 other facilities necessary or convenient for the operation of those
2828 facilities.
2929 Sec. 4011.0102. NATURE OF DISTRICT. The Puerto Verde Port
3030 Authority District is a special district created under Section 59,
3131 Article XVI, Texas Constitution.
3232 Sec. 4011.0103. PURPOSE; DECLARATION OF INTENT. (a) The
3333 creation of the district is essential to accomplish the purposes of
3434 Sections 52 and 52-a, Article III, and Section 59, Article XVI,
3535 Texas Constitution, and other public purposes stated in this
3636 chapter.
3737 (b) By creating the district and in authorizing the county
3838 and other political subdivisions to contract with the district, the
3939 legislature has established a program to accomplish the public
4040 purposes set out in Section 52-a, Article III, Texas Constitution.
4141 (c) The creation of the district is necessary to promote,
4242 develop, encourage, and maintain employment, commerce,
4343 transportation, housing, tourism, recreation, the arts,
4444 entertainment, economic development, safety, and the public
4545 welfare in the district.
4646 Sec. 4011.0104. FINDINGS OF BENEFIT AND PUBLIC PURPOSE.
4747 (a) All land and other property included in the district will
4848 benefit from the improvements and services to be provided by the
4949 district under powers conferred by Sections 52 and 52-a, Article
5050 III, and Section 59, Article XVI, Texas Constitution, and other
5151 powers granted under this chapter.
5252 (b) The district is created to serve a public use and
5353 benefit.
5454 (c) The creation of the district is in the public interest
5555 and is essential to further the public purposes of:
5656 (1) developing and diversifying the economy of the
5757 state;
5858 (2) eliminating unemployment and underemployment; and
5959 (3) developing or expanding transportation and
6060 commerce.
6161 (d) The district will:
6262 (1) promote the health, safety, and general welfare of
6363 residents, employers, potential employees, employees, visitors,
6464 and consumers in the district, and of the public;
6565 (2) provide needed funding for the district to
6666 preserve, maintain, and enhance the economic health and vitality of
6767 the district territory as a community and business center;
6868 (3) promote the health, safety, welfare, and enjoyment
6969 of the public by providing pedestrian ways and by landscaping and
7070 developing certain areas in the district, which are necessary for
7171 the restoration, preservation, and enhancement of scenic beauty;
7272 and
7373 (4) provide for water, wastewater, drainage, road,
7474 rail, port, navigation, and recreational facilities for the
7575 district.
7676 (e) Pedestrian ways along or across a street, whether at
7777 grade or above or below the surface, and street lighting, street
7878 landscaping, parking, and street art objects are parts of and
7979 necessary components of a street and are considered to be a street
8080 or road improvement.
8181 (f) The district will not act as the agent or
8282 instrumentality of any private interest even though the district
8383 will benefit many private interests as well as the public.
8484 Sec. 4011.0105. INITIAL DISTRICT TERRITORY. (a) The
8585 district is initially composed of the territory described by
8686 Section 2 of the Act enacting this chapter.
8787 (b) The boundaries and field notes contained in Section 2 of
8888 the Act enacting this chapter form a closure. A mistake in the
8989 field notes or in copying the field notes in the legislative process
9090 does not affect the district's:
9191 (1) organization, existence, or validity;
9292 (2) right to issue any type of bonds for the purposes
9393 for which the district is created or to pay the principal of and
9494 interest on the bonds;
9595 (3) right to impose or collect an assessment or tax; or
9696 (4) legality or operation.
9797 Sec. 4011.0106. ELIGIBILITY FOR INCLUSION IN SPECIAL ZONES.
9898 All or any part of the area of the district is eligible to be
9999 included in:
100100 (1) a tax increment reinvestment zone created under
101101 Chapter 311, Tax Code; or
102102 (2) a tax abatement reinvestment zone created under
103103 Chapter 312, Tax Code.
104104 Sec. 4011.0107. APPLICABILITY OF MUNICIPAL MANAGEMENT
105105 DISTRICTS LAW. Except as otherwise provided by this chapter,
106106 Chapter 375, Local Government Code, applies to the district.
107107 Sec. 4011.0108. CONSTRUCTION OF CHAPTER. This chapter
108108 shall be liberally construed in conformity with the findings and
109109 purposes stated in this chapter.
110110 SUBCHAPTER B. BOARD OF DIRECTORS
111111 Sec. 4011.0201. GOVERNING BODY; TERMS. (a) The district is
112112 governed by a board of five elected voting directors who serve
113113 staggered terms of four years.
114114 (b) Voting directors are elected in the manner provided by
115115 Subchapter D, Chapter 49, Water Code.
116116 Sec. 4011.0202. COMPENSATION; EXPENSES. (a) The district
117117 may compensate each voting director in an amount not to exceed $150
118118 for each board meeting. The total amount of compensation for each
119119 voting director in one year may not exceed $7,200.
120120 (b) A director is entitled to reimbursement for necessary
121121 and reasonable expenses incurred in carrying out the duties and
122122 responsibilities of the board.
123123 (c) Sections 375.069 and 375.070, Local Government Code, do
124124 not apply to a voting director.
125125 Sec. 4011.0203. INITIAL DIRECTORS. (a) The initial board
126126 consists of the following directors:

139139 (b) Of the initial directors, the terms of directors
140140 appointed for positions one through three expire June 1, 2027, and
141141 the terms of directors appointed for positions four and five expire
142142 June 1, 2029.
143143 Sec. 4011.0204. EX OFFICIO DIRECTORS. (a) In addition to
144144 directors elected under Section 4011.0201, the commissioners court
145145 of the county may appoint up to two persons who are officials of or
146146 employed by the county to serve as nonvoting ex officio directors.
147147 An ex officio director serves a term of four years.
148148 (b) An ex officio director is not counted as a voting
149149 director for purposes of establishing a quorum.
150150 (c) An ex officio director:
151151 (1) is entitled to receive the same notices and
152152 information regarding the district as a voting director; and
153153 (2) may attend any board meeting, regardless of
154154 whether the meeting is open or closed to the public.
155155 SUBCHAPTER C. POWERS AND DUTIES
156156 Sec. 4011.0301. GENERAL POWERS AND DUTIES. (a) The
157157 district has the powers and duties necessary to accomplish the
158158 purposes for which the district is created.
159159 (b) The district may contract with a governmental or private
160160 entity, including the county, to carry out an action, power, or duty
161161 authorized by this chapter or to accomplish the purposes for which
162162 the district is created.
163163 Sec. 4011.0302. IMPROVEMENT PROJECTS AND SERVICES. (a) The
164164 district, using any money available to the district for the
165165 purpose, may provide, design, construct, acquire, improve,
166166 relocate, operate, maintain, or finance an improvement project or
167167 service authorized under this chapter or Chapter 375, Local
168168 Government Code.
169169 (b) The implementation of a district project or service is a
170170 governmental function or service for the purposes of Chapter 791,
171171 Government Code.
172172 Sec. 4011.0303. NONPROFIT CORPORATION. (a) The board by
173173 resolution may authorize the creation of a nonprofit corporation to
174174 assist and act for the district in implementing a project or
175175 providing a service authorized by this chapter.
176176 (b) The nonprofit corporation:
177177 (1) has each power of and is considered to be a local
178178 government corporation created under Subchapter D, Chapter 431,
179179 Transportation Code; and
180180 (2) may implement any project and provide any service
181181 authorized by this chapter.
182182 (c) The board shall appoint the board of directors of the
183183 nonprofit corporation. The board of directors of the nonprofit
184184 corporation shall serve in the same manner as the board of directors
185185 of a local government corporation created under Subchapter D,
186186 Chapter 431, Transportation Code, except that a board member is not
187187 required to reside in the district.
188188 Sec. 4011.0304. NAVIGATION DISTRICT POWERS. The district
189189 has the powers provided by the general law of this state applicable
190190 to navigation districts created under Section 59, Article XVI,
191191 Texas Constitution, including Chapters 60 and 62, Water Code.
192192 Sec. 4011.0305. LAW ENFORCEMENT SERVICES. To protect the
193193 public interest, the district may contract with a qualified party,
194194 including the county, to provide law enforcement services in the
195195 district for a fee.
196196 Sec. 4011.0306. MEMBERSHIP IN CHARITABLE ORGANIZATIONS.
197197 The district may join and pay dues to a charitable or nonprofit
198198 organization that performs a service or provides an activity
199199 consistent with the furtherance of a district purpose.
200200 Sec. 4011.0307. ECONOMIC DEVELOPMENT PROGRAMS. (a) The
201201 district may engage in activities that accomplish the economic
202202 development purposes of the district.
203203 (b) The district may establish and provide for the
204204 administration of one or more programs to promote state or local
205205 economic development and to stimulate business and commercial
206206 activity in the district, including programs to:
207207 (1) make loans and grants of public money; and
208208 (2) provide district personnel and services.
209209 (c) The district may create economic development programs
210210 and exercise the economic development powers provided to
211211 municipalities by:
212212 (1) Chapter 380, Local Government Code; and
213213 (2) Subchapter A, Chapter 1509, Government Code.
214214 Sec. 4011.0308. PARKING FACILITIES. (a) The district may
215215 acquire, lease as lessor or lessee, construct, develop, own,
216216 operate, and maintain parking facilities or a system of parking
217217 facilities, including lots, garages, parking terminals, or other
218218 structures or accommodations for parking motor vehicles off the
219219 streets and related appurtenances.
220220 (b) The district's parking facilities serve the public
221221 purposes of the district and are owned, used, and held for a public
222222 purpose even if leased or operated by a private entity for a term of
223223 years.
224224 (c) The district's parking facilities are parts of and
225225 necessary components of a street and are considered to be a street
226226 or road improvement.
227227 (d) The development and operation of the district's parking
228228 facilities may be considered an economic development program.
229229 Sec. 4011.0309. ADDING OR EXCLUDING LAND. The district may
230230 add or exclude land in the manner provided by Subchapter J, Chapter
231231 49, Water Code, or by Subchapter H, Chapter 54, Water Code.
232232 Sec. 4011.0310. DISBURSEMENTS AND TRANSFERS OF MONEY. The
233233 board by resolution shall establish the number of directors'
234234 signatures and the procedure required for a disbursement or
235235 transfer of district money.
236236 Sec. 4011.0311. RAIL FACILITIES. The district may
237237 construct, acquire, improve, maintain, finance, and operate rail
238238 facilities, and improvements in aid of those facilities, for
239239 commuter, freight, and other rail purposes.
240240 Sec. 4011.0312. BRIDGE FACILITIES. The district may
241241 construct, acquire, improve, maintain, finance, and operate bridge
242242 facilities and improvements, including toll bridges.
243243 Sec. 4011.0313. EMINENT DOMAIN. The district may exercise
244244 the power of eminent domain in the manner provided by Section
245245 49.222, Water Code.
246246 SUBCHAPTER D. ASSESSMENTS
247247 Sec. 4011.0401. PETITION REQUIRED FOR FINANCING SERVICES
248248 AND IMPROVEMENTS WITH ASSESSMENTS. (a) The board may not finance a
249249 service or improvement project with assessments under this chapter
250250 unless a written petition requesting that service or improvement
251251 has been filed with the board.
252252 (b) A petition filed under Subsection (a) must be signed by
253253 the owners of a majority of the assessed value of real property in
254254 the district subject to assessment according to the most recent
255255 certified tax appraisal roll for the county.
256256 Sec. 4011.0402. ASSESSMENTS; LIENS FOR ASSESSMENTS. (a)
257257 The board by resolution may impose and collect an assessment for any
258258 purpose authorized by this chapter in all or any part of the
259259 district.
260260 (b) An assessment, a reassessment, or an assessment
261261 resulting from an addition to or correction of the assessment roll
262262 by the district, penalties and interest on an assessment or
263263 reassessment, an expense of collection, and reasonable attorney's
264264 fees incurred by the district:
265265 (1) are a first and prior lien against the property
266266 assessed;
267267 (2) are superior to any other lien or claim other than
268268 a lien or claim for county, school district, or municipal ad valorem
269269 taxes; and
270270 (3) are the personal liability of and a charge against
271271 the owners of the property even if the owners are not named in the
272272 assessment proceedings.
273273 (c) The lien is effective from the date of the board's
274274 resolution imposing the assessment until the date the assessment is
275275 paid. The board may enforce the lien in the same manner that the
276276 board may enforce an ad valorem tax lien against real property.
277277 (d) The board may make a correction to or deletion from the
278278 assessment roll that does not increase the amount of assessment of
279279 any parcel of land without providing notice and holding a hearing in
280280 the manner required for additional assessments.
281281 SUBCHAPTER E. TAXES AND BONDS
282282 Sec. 4011.0501. TAX ELECTION REQUIRED. (a) The district
283283 must hold an election in the manner provided by Chapter 49, Water
284284 Code, or, if applicable, Chapter 375, Local Government Code, to
285285 obtain voter approval before the district may impose an ad valorem
286286 tax.
287287 (b) Section 375.243, Local Government Code, does not apply
288288 to the district.
289289 Sec. 4011.0502. OPERATION AND MAINTENANCE TAX. (a) If
290290 authorized by a majority of the district voters voting at an
291291 election under Section 4011.0501, the district may impose an
292292 operation and maintenance tax on taxable property in the district
293293 in the manner provided by Section 49.107, Water Code, for any
294294 district purpose, including to:
295295 (1) maintain and operate the district;
296296 (2) construct or acquire improvements; or
297297 (3) provide a service.
298298 (b) The board shall determine the operation and maintenance
299299 tax rate. The rate may not exceed the rate approved at the
300300 election.
301301 Sec. 4011.0503. AUTHORITY TO BORROW MONEY AND TO ISSUE
302302 BONDS AND OTHER OBLIGATIONS. (a) The district may borrow money on
303303 terms determined by the board.
304304 (b) The district may issue bonds, notes, or other
305305 obligations payable wholly or partly from ad valorem taxes,
306306 assessments, impact fees, tolls, fares, charges, fees, revenue,
307307 contract payments, grants, or other district money, or any
308308 combination of those sources of money, to pay for any authorized
309309 district purpose.
310310 Sec. 4011.0504. BONDS SECURED BY REVENUE OR CONTRACT
311311 PAYMENTS. The district may issue, without an election, bonds
312312 secured by:
313313 (1) revenue other than ad valorem taxes, including
314314 contract revenues; or
315315 (2) contract payments, provided that the requirements
316316 of Section 49.108, Water Code, have been met.
317317 Sec. 4011.0505. BONDS SECURED BY AD VALOREM TAXES;
318318 ELECTIONS. (a) If authorized at an election under Section
319319 4011.0501, the district may issue bonds payable from ad valorem
320320 taxes.
321321 (b) At the time the district issues bonds payable wholly or
322322 partly from ad valorem taxes, the board shall provide for the annual
323323 imposition of a continuing direct annual ad valorem tax, without
324324 limit as to rate or amount, for each year that all or part of the
325325 bonds are outstanding as required and in the manner provided by
326326 Sections 54.601 and 54.602, Water Code.
327327 (c) All or any part of any facilities or improvements that
328328 may be acquired by a district by the issuance of its bonds may be
329329 submitted as a single proposition or as several propositions to be
330330 voted on at the election.
331331 SUBCHAPTER I. DISSOLUTION
332332 Sec. 4011.0901. DISSOLUTION. (a) The board shall dissolve
333333 the district on written petition filed with the board by the owners
334334 of:
335335 (1) at least two-thirds of the assessed value of the
336336 property subject to assessment by the district based on the most
337337 recent certified county property tax rolls; or
338338 (2) at least two-thirds of the surface area of the
339339 district, excluding roads, streets, highways, utility
340340 rights-of-way, other public areas, and other property exempt from
341341 assessment by the district according to the most recent certified
342342 county property tax rolls.
343343 (b) The board by majority vote may dissolve the district at
344344 any time.
345345 (c) The district may not be dissolved by its board under
346346 Subsection (a) or (b) if the district:
347347 (1) has any outstanding bonded or other indebtedness
348348 until that bonded or other indebtedness has been repaid or defeased
349349 in accordance with the order or resolution authorizing the issuance
350350 of the bonded or other indebtedness;
351351 (2) has a contractual obligation to pay money until
352352 that obligation has been fully paid in accordance with the
353353 contract; or
354354 (3) owns, operates, or maintains public works,
355355 facilities, or improvements unless the district contracts with
356356 another person for the ownership, operation, or maintenance of the
357357 public works, facilities, or improvements.
358358 (d) Sections 375.261, 375.262, and 375.264, Local
359359 Government Code, do not apply to the district.
360360 SECTION 2. The Puerto Verde Port Authority District
361361 initially includes all territory contained in the following area:

363363 Being a boundary survey of 1898.24 acres, more or less, of land
364364 lying in Maverick County, Texas, being out of and parts of P. W.

915915 SECTION 3. (a) The legal notice of the intention to
916916 introduce this Act, setting forth the general substance of this
917917 Act, has been published as provided by law, and the notice and a
918918 copy of this Act have been furnished to all persons, agencies,
919919 officials, or entities to which they are required to be furnished
920920 under Section 59, Article XVI, Texas Constitution, and Chapter 313,
921921 Government Code.
922922 (b) The governor, one of the required recipients, has
923923 submitted the notice and Act to the Texas Commission on
924924 Environmental Quality.
925925 (c) The Texas Commission on Environmental Quality has filed
926926 its recommendations relating to this Act with the governor,
927927 lieutenant governor, and speaker of the house of representatives
928928 within the required time.
929929 (d) All requirements of the constitution and laws of this
930930 state and the rules and procedures of the legislature with respect
931931 to the notice, introduction, and passage of this Act have been
932932 fulfilled and accomplished.
933933 SECTION 4. (a) Section 4011.0313, Special District Local
934934 Laws Code, as added by Section 1 of this Act, takes effect only if
935935 this Act receives a two-thirds vote of all the members elected to
936936 each house.
937937 (b) If this Act does not receive a two-thirds vote of all the
938938 members elected to each house, Subchapter C, Chapter 4011, Special
939939 District Local Laws Code, as added by Section 1 of this Act, is
940940 amended by adding Section 4011.0313 to read as follows:
941941 Sec. 4011.0313. NO EMINENT DOMAIN POWER. The district may
942942 not exercise the power of eminent domain.
943943 (c) This section is not intended to be an expression of a
944944 legislative interpretation of the requirements of Section 17(c),
945945 Article I, Texas Constitution.
946946 SECTION 5. This Act takes effect immediately if it receives
947947 a vote of two-thirds of all the members elected to each house, as
948948 provided by Section 39, Article III, Texas Constitution. If this
949949 Act does not receive the vote necessary for immediate effect, this
950950 Act takes effect September 1, 2025.
