77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to an e-cigarette and tobacco use prevention and cessation
1010 program established by the Department of State Health Services.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Subchapter D, Chapter 1001, Health and Safety
1313 Code, is amended by adding Section 1001.090 to read as follows:
1414 Sec. 1001.090. E-CIGARETTE AND TOBACCO USE PREVENTION AND
1515 CESSATION PROGRAM. (a) Using available resources, the department
1616 shall develop and implement an e-cigarette and tobacco use
1717 prevention and cessation program. The program must include:
1818 (1) a telephone hotline that provides counseling
1919 regarding e-cigarette and tobacco cessation, using current best
2020 practices; and
2121 (2) information about the program and other services
2222 the department or commission provides that are available to women
2323 who are pregnant or postpartum.
2424 (b) The department may enter into an agreement with a
2525 nonprofit organization to implement this section.
2626 (c) The department shall prioritize and accept all eligible
2727 applicants for the program described by Subsection (a) who are
2828 pregnant or gave birth in the preceding year.
2929 (d) The executive commissioner may adopt rules necessary to
3030 implement this section.
3131 SECTION 2. This Act takes effect September 1, 2025.
