11 | 11 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
12 | 12 | SECTION 1. Subchapter D, Chapter 1001, Health and Safety | |
13 | 13 | Code, is amended by adding Section 1001.090 to read as follows: | |
14 | 14 | Sec. 1001.090. E-CIGARETTE AND TOBACCO USE PREVENTION AND | |
15 | 15 | CESSATION PROGRAM. (a) Using available resources, the department | |
16 | 16 | shall develop and implement an e-cigarette and tobacco use | |
17 | 17 | prevention and cessation program. The program must include: | |
18 | 18 | (1) a telephone hotline that provides counseling | |
19 | 19 | regarding e-cigarette and tobacco cessation, using current best | |
20 | 20 | practices; and | |
21 | 21 | (2) information about the program and other services | |
22 | 22 | the department or commission provides that are available to women | |
23 | 23 | who are pregnant or postpartum. | |
24 | 24 | (b) The department may enter into an agreement with a | |
25 | 25 | nonprofit organization to implement this section. | |
26 | 26 | (c) The department shall prioritize and accept all eligible | |
27 | 27 | applicants for the program described by Subsection (a) who are | |
28 | 28 | pregnant or gave birth in the preceding year. | |
29 | 29 | (d) The executive commissioner may adopt rules necessary to | |
30 | 30 | implement this section. | |
31 | 31 | SECTION 2. This Act takes effect September 1, 2025. |
