77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to the Medicaid eligibility of certain women following a
1010 pregnancy.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Section 32.024(l-1), Human Resources Code, is
1313 amended to read as follows:
1414 (l-1) The commission shall continue to provide medical
1515 assistance to a woman who is eligible for medical assistance for
1616 pregnant women for a period of not less than 24 [:
1717 [(1) six] months following the last month of the
1818 woman's pregnancy [date the woman delivers or experiences an
1919 involuntary miscarriage; and
2020 [(2) 12 months that begins on the last day of the
2121 woman's pregnancy and ends on the last day of the month in which the
2222 12-month period ends in accordance with Section 1902(e)(16), Social
2323 Security Act (42 U.S.C. Section 1396a(e)(16))].
2424 SECTION 2. If before implementing any provision of this Act
2525 a state agency determines that a waiver or authorization from a
2626 federal agency is necessary for implementation of that provision,
2727 the agency affected by the provision shall request the waiver or
2828 authorization and may delay implementing that provision until the
2929 waiver or authorization is granted.
3030 SECTION 3. This Act takes effect September 1, 2025.
