77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to the creation of a temporary educator certificate for
1010 educators certified by other states.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Subchapter B, Chapter 21, Education Code, is
1313 amended by adding Section 21.0521 to read as follows:
1414 Sec. 21.0521. TEMPORARY CERTIFICATION OF EDUCATORS FROM
1515 OUTSIDE THIS STATE. (a) The board shall:
1616 (1) establish a temporary certificate for educators
1717 certified by other states; and
1818 (2) immediately issue a certificate described by
1919 Subdivision (1) to a person who applies for a certificate issued
2020 under Section 21.052.
2121 (b) The board may rescind a temporary certificate issued to
2222 a person under this section if the board determines as a result of a
2323 review of the person's credentials that the person does not meet the
2424 eligibility requirements under Subsection (c).
2525 (c) To be eligible for a temporary certificate issued under
2626 this section, a person must:
2727 (1) hold a valid, unexpired, non-temporary
2828 certificate or similar credential in another state that qualifies
2929 the person to be employed as an educator in that state; and
3030 (2) hold a bachelor's degree from an institution of
3131 higher education that is, and at the time the person received the
3232 degree was, accredited.
3333 (d) Except as provided by Subsection (e), a temporary
3434 certificate issued under this section expires on the earlier of:
3535 (1) the first anniversary of the date the certificate
3636 was issued; or
3737 (2) the date the person is issued a certificate under
3838 Section 21.052.
3939 (e) A temporary certificate issued under this section to an
4040 educator who is the spouse of a person serving on active duty as a
4141 member of the armed forces of the United States, as those terms are
4242 defined by Section 55.001, Occupations Code, expires on the third
4343 anniversary of the date the certificate was issued or a later date
4444 specified by board rule.
4545 (f) A temporary certificate issued under this section may
4646 not be reissued or renewed.
4747 SECTION 2. Sections 21.052(c), (d), (d-1), and (e),
4848 Education Code, are repealed.
4949 SECTION 3. As soon as practicable after the effective date
5050 of this Act, the State Board for Educator Certification shall adopt
5151 rules necessary to implement Section 21.0521, Education Code, as
5252 added by this Act.
5353 SECTION 4. This Act takes effect immediately if it receives
5454 a vote of two-thirds of all the members elected to each house, as
5555 provided by Section 39, Article III, Texas Constitution. If this
5656 Act does not receive the vote necessary for immediate effect, this
5757 Act takes effect September 1, 2025.
