77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to liability insurance certain peace officers obtain for
1010 damages resulting from the officers' misconduct.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Chapter 612, Government Code, is amended by
1313 adding Section 612.006 to read as follows:
1414 Sec. 612.006. LIABILITY INSURANCE COVERAGE FOR PEACE
1515 OFFICER MISCONDUCT. (a) In this section:
1616 (1) "Law enforcement agency" means an agency of this
1717 state or an agency of a political subdivision of this state
1818 authorized by law to employ peace officers.
1919 (2) "Peace officer" means an individual elected,
2020 appointed, or employed to serve as a peace officer for a
2121 governmental entity under Article 2A.001, Code of Criminal
2222 Procedure, or other law.
2323 (b) This section applies only to a peace officer, other than
2424 a reserve peace officer, who:
2525 (1) works as a peace officer for a law enforcement
2626 agency; and
2727 (2) is entitled to benefits offered to a full-time
2828 peace officer by the employing agency, such as retirement benefits.
2929 (c) A law enforcement agency may not employ a peace officer
3030 to whom this section applies unless the peace officer obtains and
3131 continuously maintains liability insurance to cover damages
3232 resulting from any misconduct, including intentional or negligent
3333 acts, the peace officer commits while acting in the scope of the
3434 peace officer's employment for the law enforcement agency.
3535 (d) Liability insurance obtained and maintained for
3636 purposes of Subsection (c) must comply with the rules the
3737 commissioner of insurance adopts under Subsection (e).
3838 (e) The commissioner of insurance shall adopt rules that:
3939 (1) set a minimum liability insurance coverage amount
4040 for a policy allowing a reasonable number of victims to be
4141 compensated; and
4242 (2) require a policy to state the policy is provided in
4343 accordance with and is subject to this section.
4444 SECTION 2. Not later than January 1, 2026, the commissioner
4545 of insurance shall adopt rules to implement Section 612.006,
4646 Government Code, as added by this Act.
4747 SECTION 3. Section 612.006(c), Government Code, as added by
4848 this Act, applies only to a peace officer employed on or after
4949 September 1, 2026.
5050 SECTION 4. This Act takes effect September 1, 2025.
