88 AN ACT
99 relating to a grant program for neighborhood organization
1010 pedestrian infrastructure administered by the Texas Department of
1111 Housing and Community Affairs.
1212 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1313 SECTION 1. The heading to Subchapter K, Chapter 2306,
1414 Government Code, is amended to read as follows:
1515 SUBCHAPTER K. HOUSING AND INFRASTRUCTURE PROGRAMS
1616 SECTION 2. Subchapter K, Chapter 2306, Government Code, is
1717 amended by adding Section 2306.2595 to read as follows:
1818 Sec. 2306.2595. PEDESTRIAN INFRASTRUCTURE PROGRAM. (a) In
1919 this section:
2020 (1) "Grant" means financial assistance that is awarded
2121 in the form of money to a neighborhood organization for a specific
2222 purpose and that is not required to be repaid. For purposes of this
2323 section, the term includes a forgivable loan.
2424 (2) "Grant fund" means the pedestrian infrastructure
2525 grant fund.
2626 (b) The department shall award grants to neighborhood
2727 organizations to construct pedestrian infrastructure related to
2828 sidewalks, curbs, or pedestrian lighting. The department may only
2929 award a grant under a contract between the department and a grant
3030 recipient that includes provisions under which the department is
3131 given sufficient control to ensure the public purpose of protecting
3232 the safety of the public is accomplished and the state receives the
3333 return benefit.
3434 (c) The grant fund is a dedicated account in the general
3535 revenue fund and consists of:
3636 (1) appropriations of money to the grant fund by the
3737 legislature;
3838 (2) gifts, grants, including federal grants, and other
3939 donations received for the grant fund; and
4040 (3) interest earned on the investment of money in the
4141 grant fund.
4242 (d) The grant fund may be used by the department only to:
4343 (1) award grants under this section; and
4444 (2) administer the grant program under this section.
4545 (e) Section 403.0956 does not apply to the grant fund.
4646 (f) The department shall adopt rules necessary to
4747 administer this section.
4848 SECTION 3. This Act takes effect September 1, 2025.
