77 AN ACT
88 relating to the participation by non-enrolled students in
99 University Interscholastic League-sponsored activities.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Section 33.0832, Education Code, is amended to
1212 read as follows:
1313 Sec. 33.0832. EQUAL OPPORTUNITY FOR CERTAIN STUDENTS TO
1414 PARTICIPATE IN UNIVERSITY INTERSCHOLASTIC LEAGUE ACTIVITIES. (a)
1515 In this section:
1616 (1) "League" means the University Interscholastic
1717 League.
1818 (2) "Non-enrolled student" means a student who
1919 receives instruction as described by Section 29.916(a)(1) from a
2020 nonpublic school.
2121 (b) Nothing in this section may be construed to affect the
2222 holding in Texas Educ. Agency v. Leeper, 893 S.W.2d 432 (Tex. 1994),
2323 classifying home schools as private schools. The legislature finds
2424 that a home school is a private school for purposes of this section.
2525 (c) Except as provided by Subsections (c-2) and (i), a
2626 public school that participates in an activity sponsored by the
2727 league shallmay provide a non-enrolled student, who otherwise meets
2828 league eligibility standards to represent that school in a league
2929 activity, with the opportunity to participate in the activity on
3030 behalf of the school in the same manner that the school provides the
3131 opportunity to participate to students enrolled in the school.
3232 (c-1) When assigning league classification to a public
3333 school based on student enrollment, the league must use the same
3434 student enrollment calculation formula for a school that allows a
3535 non-enrolled student to participate in a league activity as
3636 provided by Subsection (c) as the formula used to determine the
3737 student enrollment of a school that does not allow a non-enrolled
3838 student to participate in the league activity.
3939 (c-2) A board of trustees of a school district may decline
4040 to grant non-enrolled students access to league activities at a
4141 campus of the district or school by taking a record vote that
4242 receives the support of a majority of the trustees.
4343 (d) A non-enrolled student who seeks to participate or
4444 participates in a league activity on behalf of a school is subject
4545 to the following relevant policies that apply to students enrolled
4646 in the school:
4747 (1) registration for league activities;
4848 (2) age eligibility;
4949 (3) fees;
5050 (4) insurance;
5151 (5) transportation;
5252 (6) physical condition;
5353 (7) qualifications;
5454 (8) responsibilities;
5555 (9) event schedules;
5656 (10) standards of behavior; and
5757 (11) performance.
5858 (e) Except as provided by (e-1), aA non-enrolled student may
5959 only participate in a league activity for the school in the school
6060 district that the student would be eligible to attend based on the
6161 student's residential address. A non-enrolled student who seeks to
6262 participate in a league activity on behalf of a school shall be
6363 required to establish minimum proof of residency acceptable to the
6464 district in the same manner as an applicant to attend a school in
6565 the district under Section 25.001.
6666 (e-1) If a school has declined to grant non-enrolled
6767 students access to league activities as described in Subsection
6868 (c-2), a non-enrolled student eligible to attend that school based
6969 on their residential address may participate in a league activity
7070 for the public school closest to their residential address that has
7171 not declined to grant non-enrolled students access to league
7272 activities as described by Subsection (c-2).
7373 (f) The parent or person standing in parental relation to a
7474 non-enrolled student is responsible for oversight of academic
7575 standards relating to the student's participation in a league
7676 activity. As a condition of eligibility to participate in a league
7777 activity during the first six weeks of a school year, a non-enrolled
7878 student must demonstrate grade-level academic proficiency on any
7979 nationally recognized, norm-referenced assessment instrument, such
8080 as the Iowa Test of Basic Skills, Stanford Achievement Test,
8181 California Achievement Test, or Comprehensive Test of Basic Skills.
8282 A non-enrolled student demonstrates the required academic
8383 proficiency by achieving a composite, core, or survey score that is
8484 within the average or higher than average range of scores, as
8585 established by the applicable testing service. For purposes of 25
8686 this subsection, a school district shall accept assessment results
8787 administered or reported by a third party.
8888 (g) A non-enrolled student's demonstration of academic
8989 proficiency under Subsection (f) is sufficient for purposes of that
9090 subsection for the school year in which the student achieves the
9191 required score and the subsequent school year.
9292 (h) After the first six weeks of a school year, the parent or
9393 person standing in parental relation to a non-enrolled student
9494 participating in a league activity on behalf of a public school must
9595 periodically, in accordance with the school's grading calendar,
9696 provide written verification to the school indicating that the
9797 student is receiving a passing grade in each course or subject being
9898 taught.
9999 (i) A non-enrolled student is not authorized by this section
100100 to participate in a league activity during the remainder of any
101101 school year during which the student was previously enrolled in a
102102 public school.
103103 (j) The league may not prohibit a non-enrolled student from
104104 participating in league activities in the manner authorized by this
105105 section.
106106 (k) With respect to a non-enrolled student's education
107107 program, nothing in this section shall be construed to permit an
108108 agency of this state, a public school district, or any other
109109 governmental body to exercise control, regulatory authority, or
110110 supervision over a non-enrolled student or a parent or person
111111 standing in parental relation to a non-enrolled student beyond the
112112 control, regulatory authority, or supervision required to
113113 participate in a league activity.
114114 (l) Subject only to eligibility requirements under this
115115 section for a non-enrolled student to participate in a league
116116 activity:
117117 (1) the curriculum or assessment requirements,
118118 performance standards, practices, or creed of the education program
119119 provided to a non-enrolled student may not be required to be changed
120120 in order for the non-enrolled student to participate in a league
121121 activity; and
122122 (2) for a non-enrolled student participating in an 26
123123 education program on January 1, 2021, the education program
124124 provided to that student may not be required to comply with any
125125 state law or agency rule relating to that education program unless
126126 the law or rule was in effect on January 1, 2021.
127127 (m) Notwithstanding any other law, a non-enrolled student
128128 who participates in a league activity under this section is subject
129129 to the immunization requirements and exceptions of Section 38.001
130130 in the same manner as a public school student.
131131 SECTION 2. This Act applies beginning with the 2025-2026
132132 school year.
133133 SECTION 3. This Act takes effect immediately if it receives
134134 a vote of two-thirds of all the members elected to each house, as
135135 provided by Section 39, Article III, Texas Constitution. If this
136136 Act does not receive the vote necessary for immediate effect, this
137137 Act takes effect September 1, 2025.
