77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to the definition of "eligible school district" for
1010 purposes of the study of school district property values conducted
1111 by the comptroller of public accounts.
1212 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1313 SECTION 1. Section 403.3011(2), Government Code, is amended
1414 to read as follows:
1515 (2) "Eligible school district" means a school district
1616 for which the comptroller has determined the following:
1717 (A) in the most recent study, the local value is
1818 invalid under Section 403.302(c) and does not exceed the state
1919 value for the school district determined in the study; and
2020 (B) in the two studies preceding the most recent
2121 study, the school district's local value was valid under Section
2222 403.302(c)[;
2323 [(C) in the most recent study, the aggregate
2424 local value of all of the categories of property sampled by the
2525 comptroller is not less than 90 percent of the lower limit of the
2626 margin of error as determined by the comptroller of the aggregate
2727 value as determined by the comptroller of all of the categories of
2828 property sampled by the comptroller; and
2929 [(D) the appraisal district that appraises
3030 property for the school district was in compliance with the scoring
3131 requirement of the comptroller's most recent review of the
3232 appraisal district conducted under Section 5.102, Tax Code].
3333 SECTION 2. The change in law made by this Act applies only
3434 to a study conducted under Section 403.302, Government Code, for a
3535 tax year that begins on or after January 1, 2026. A study conducted
3636 before that date is governed by the law in effect immediately before
3737 the effective date of this Act, and the former law is continued in
3838 effect for that purpose.
3939 SECTION 3. This Act takes effect immediately if it receives
4040 a vote of two-thirds of all the members elected to each house, as
4141 provided by Section 39, Article III, Texas Constitution. If this
4242 Act does not receive the vote necessary for immediate effect, this
4343 Act takes effect September 1, 2025.
