77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to the period of continuous eligibility for the medical
1010 assistance program.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Section 32.0261(b), Human Resources Code, is
1313 amended to read as follows:
1414 (b) The executive commissioner shall adopt rules in
1515 accordance with 42 U.S.C. Section 1396a(e)(12), as amended, to
1616 provide for a period of continuous eligibility [two consecutive
1717 periods of eligibility] for a child to whom this section applies
1818 [between each certification and recertification of the child's
1919 eligibility, subject to Subsections (f) and (h)]. The rules must
2020 provide that the child remains eligible for medical assistance,
2121 without additional review by the commission and regardless of
2222 changes in the child's resources or income, until the earlier of:
2323 (1) the first anniversary of the date on which the
2424 child's eligibility was determined; or
2525 (2) the child's 19th birthday.
2626 SECTION 2. Sections 32.0261(c), (d), (e), (f), (g), (h),
2727 (j), (k), and (l), Human Resources Code, are repealed.
2828 SECTION 3. If before implementing any provision of this Act
2929 a state agency determines that any other waiver or authorization
3030 from a federal agency is necessary for implementation of that
3131 provision, the agency affected by the provision shall request the
3232 waiver or authorization and may delay implementing that provision
3333 until the waiver or authorization is granted.
3434 SECTION 4. This Act takes effect September 1, 2025.
