88 AN ACT
99 relating to the transfer of a protective order.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Sections 85.064(a) and (b), Family Code, are
1212 amended to read as follows:
1313 (a) If a protective order was rendered before the filing of
1414 a suit for dissolution of marriage or suit affecting the
1515 parent-child relationship or while the suit is pending as provided
1616 by Section 85.062, the court that rendered the order shall [may], on
1717 the motion of a party or on the court's own motion, transfer the
1818 protective order to the court having jurisdiction of the suit [if
1919 the court makes the finding prescribed by Subsection (c)].
2020 (b) If a protective order that affects a party's right to
2121 possession of or access to a child is rendered after the date a
2222 final order was rendered in a suit affecting the parent-child
2323 relationship, on the motion of a party or on the court's own motion,
2424 the court shall [may] transfer the protective order to the court of
2525 continuing, exclusive jurisdiction [if the court makes the finding
2626 prescribed by Subsection (c)].
2727 SECTION 2. Section 85.064(c), Family Code, is repealed.
2828 SECTION 3. Section 85.064, Family Code, as amended by this
2929 Act, applies only to a motion to transfer a protective order that is
3030 made on or after the effective date of this Act. A motion made
3131 before the effective date of this Act is governed by the law in
3232 effect on the date the motion was made, and the former law is
3333 continued in effect for that purpose.
3434 SECTION 4. This Act takes effect September 1, 2025.
