10- is being transported on the Galveston-Port Bolivar ferry;
11- authorizing a fee.
9+ relating to authorizing the Texas Department of Transportation to
10+ provide battery service to a vehicle transported on the
11+ Galveston-Port Bolivar ferry; authorizing a fee.
1212 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1313 SECTION 1. Subchapter A, Chapter 342, Transportation Code,
1414 is amended by adding Section 342.005 to read as follows:
1515 Sec. 342.005. RESTARTING VEHICLE BATTERY ON GALVESTON-PORT
16- BOLIVAR FERRY. (a) The operator of a vehicle being transported on
17- the Galveston-Port Bolivar ferry operated by the department may
18- attempt to restart the vehicle's battery only if a ferry employee
19- confirms the absence of hazardous gas. At the request of the
20- vehicle operator, a ferry employee who has completed the training
21- described by Subsection (b) shall check for hazardous gas.
22- (b) The department shall:
23- (1) provide training to ferry employees regarding the
24- safe use of equipment to detect hazardous gas; and
25- (2) provide and maintain in good operating condition
26- equipment for detecting hazardous gas.
27- (c) The department may charge a fee for providing the
16+ BOLIVAR FERRY. (a) At the request of a vehicle operator, a
17+ qualified ferry employee may attempt to restart the battery of a
18+ motor vehicle transported on the Galveston-Port Bolivar ferry
19+ operated by the department. For purposes of this subsection, a
20+ ferry employee is qualified to provide the service described by
21+ this subsection if the employee has completed training described by
22+ Subsection (c).
23+ (b) Before providing the service described by Subsection
24+ (a), a ferry employee must confirm the absence of hazardous gas.
25+ (c) The department shall:
26+ (1) offer training to ferry personnel regarding the
27+ safe use of equipment to:
28+ (A) detect hazardous gas; and
29+ (B) restart a motor vehicle battery; and
30+ (2) provide and maintain in good operating condition:
31+ (A) equipment for detecting hazardous gas; and
32+ (B) equipment for restarting a motor vehicle
33+ battery.
34+ (d) The department may charge a fee for providing the
2835 service described by Subsection (a) in an amount set by the
2936 department that is reasonable and necessary to cover the costs of
3037 administering this section.
31- (d) Nothing in this section requires a ferry employee to
32- attempt to restart the battery of a vehicle being transported on the
33- Galveston-Port Bolivar ferry operated by the department.
3438 SECTION 2. Not later than December 1, 2025, the Texas
3539 Department of Transportation shall adopt rules necessary to
3640 administer Section 342.005, Transportation Code, as added by this
3741 Act.
3842 SECTION 3. This Act takes effect September 1, 2025.
