77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to the amount of an expenditure made by certain political
1010 subdivisions for which a competitive procurement method may be
1111 required to be used.
1212 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1313 SECTION 1. Section 44.031(a), Education Code, is amended to
1414 read as follows:
1515 (a) Except as provided by this subchapter, all school
1616 district contracts for the purchase of goods and services, except
1717 contracts for the purchase of produce or vehicle fuel, valued at
1818 [$50,000 or] more than $200,000 in the aggregate for each 12-month
1919 period shall be made by the method, of the following methods, that
2020 provides the best value for the district:
2121 (1) competitive bidding for services other than
2222 construction services;
2323 (2) competitive sealed proposals for services other
2424 than construction services;
2525 (3) a request for proposals, for services other than
2626 construction services;
2727 (4) an interlocal contract;
2828 (5) a method provided by Chapter 2269, Government
2929 Code, for construction services;
3030 (6) the reverse auction procedure as defined by
3131 Section 2155.062(d), Government Code; or
3232 (7) the formation of a political subdivision
3333 corporation under Section 304.001, Local Government Code.
3434 SECTION 2. Section 775.084(a), Health and Safety Code, is
3535 amended to read as follows:
3636 (a) Except as provided by Subsection (i), the board must
3737 submit to competitive bids an expenditure of more than $200,000
3838 [$50,000] for:
3939 (1) one item or service; or
4040 (2) more than one of the same or a similar type of item
4141 or service in a fiscal year.
4242 SECTION 3. Section 252.021(a), Local Government Code, is
4343 amended to read as follows:
4444 (a) Before a municipality may enter into a contract that
4545 requires an expenditure of more than $200,000 [$50,000] from one or
4646 more municipal funds, the municipality must:
4747 (1) comply with the procedure prescribed by this
4848 subchapter and Subchapter C for competitive sealed bidding or
4949 competitive sealed proposals;
5050 (2) use the reverse auction procedure, as defined by
5151 Section 2155.062(d), Government Code, for purchasing; or
5252 (3) comply with a method described by Chapter 2269,
5353 Government Code.
5454 SECTION 4. Section 252.0215, Local Government Code, is
5555 amended to read as follows:
5656 Sec. 252.0215. COMPETITIVE BIDDING IN RELATION TO
5757 HISTORICALLY UNDERUTILIZED BUSINESS. A municipality, in making an
5858 expenditure of more than $3,000 but not more [less] than $200,000
5959 [$50,000], shall contact at least two historically underutilized
6060 businesses on a rotating basis, based on information provided by
6161 the comptroller pursuant to Chapter 2161, Government Code. If the
6262 list fails to identify a historically underutilized business in the
6363 county in which the municipality is situated, the municipality is
6464 exempt from this section.
6565 SECTION 5. Section 262.003(a), Local Government Code, is
6666 amended to read as follows:
6767 (a) Any law that requires a county to follow a competitive
6868 procurement procedure in making a purchase requiring the
6969 expenditure of $200,000 [$50,000] or less does not apply to the
7070 purchase of an item available for purchase from only one supplier.
7171 SECTION 6. Section 262.023(a), Local Government Code, is
7272 amended to read as follows:
7373 (a) Before a county may purchase one or more items under a
7474 contract that will require an expenditure exceeding $200,000
7575 [$50,000], the commissioners court of the county must:
7676 (1) comply with the competitive bidding or competitive
7777 proposal procedures prescribed by this subchapter;
7878 (2) use the reverse auction procedure, as defined by
7979 Section 2155.062(d), Government Code, for purchasing; or
8080 (3) comply with a method described by Chapter 2269,
8181 Government Code.
8282 SECTION 7. Section 271.024, Local Government Code, is
8383 amended to read as follows:
8484 Sec. 271.024. COMPETITIVE PROCUREMENT PROCEDURE APPLICABLE
8585 TO CONTRACT. If a governmental entity is required by statute to
8686 award a contract for the construction, repair, or renovation of a
8787 structure, road, highway, or other improvement or addition to real
8888 property on the basis of competitive bids, and if the contract
8989 requires the expenditure of more than $200,000 [$50,000] from the
9090 funds of the entity, the bidding on the contract must be
9191 accomplished in the manner provided by this subchapter.
9292 SECTION 8. Section 271.054, Local Government Code, is
9393 amended to read as follows:
9494 Sec. 271.054. COMPETITIVE PROCUREMENT REQUIREMENT. Before
9595 the governing body of an issuer may enter into a contract requiring
9696 an expenditure by or imposing an obligation or liability on the
9797 issuer, or on a subdivision of the issuer if the issuer is a county,
9898 of more than $200,000 [$50,000], the governing body must:
9999 (1) submit the proposed contract to competitive
100100 procurement; or
101101 (2) use an alternate method of project delivery
102102 authorized by Chapter 2269, Government Code.
103103 SECTION 9. Sections 252.312(b) and (c), Transportation
104104 Code, are amended to read as follows:
105105 (b) If the county road engineer so recommends and the
106106 commissioners court considers it to be in the best interest of the
107107 county, a purchase in an amount of $200,000 [$50,000] or less may be
108108 made through negotiation by the commissioners court or the court's
109109 authorized representative on requisition to be approved by the
110110 commissioners court or the county auditor without advertising for
111111 competitive bids.
112112 (c) A purchase may not be divided or reduced to avoid the
113113 competitive bidding requirement on a purchase that would otherwise
114114 cost more than $200,000 [$50,000].
115115 SECTION 10. The changes in law made by this Act apply only
116116 to a purchase made on or after the effective date of this Act. A
117117 purchase made before the effective date of this Act is governed by
118118 the law as it existed immediately before the effective date of this
119119 Act, and that law is continued in effect for that purpose.
120120 SECTION 11. This Act takes effect September 1, 2025.
