77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to the release on personal bond of certain defendants
1010 charged with a misdemeanor or state jail felony.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Article 17.03(a), Code of Criminal Procedure, is
1313 amended to read as follows:
1414 (a) Except as otherwise provided by this chapter
1515 [Subsection (b) or (b-1)], a magistrate may, in the magistrate's
1616 discretion, release the defendant on personal bond without sureties
1717 or other security.
1818 SECTION 2. Chapter 17, Code of Criminal Procedure, is
1919 amended by adding Article 17.034 to read as follows:
2020 Art. 17.034. RELEASE ON PERSONAL BOND OF CERTAIN DEFENDANTS
2121 CHARGED WITH MISDEMEANOR OR STATE JAIL FELONY. Notwithstanding
2222 Article 17.03(b), or a bond schedule adopted or a standing order
2323 entered by a judge, a magistrate shall release a defendant charged
2424 with a misdemeanor or state jail felony on personal bond unless the
2525 release on personal bond is otherwise prohibited by law or the
2626 magistrate makes a finding that no nonmonetary conditions of
2727 release are sufficient to reasonably ensure:
2828 (1) the defendant's appearance in court as required;
2929 and
3030 (2) the safety of the community, law enforcement, and
3131 the victim of the alleged offense.
3232 SECTION 3. The change in law made by this Act applies only
3333 to a person who is arrested on or after the effective date of this
3434 Act. A person arrested before the effective date of this Act is
3535 governed by the law in effect on the date the person was arrested,
3636 and the former law is continued in effect for that purpose.
3737 SECTION 4. This Act takes effect September 1, 2025.
