88 AN ACT
99 relating to the creation of certain criminal offenses concerning
1010 firearm sales at gun shows.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Section 46.01, Penal Code, is amended by adding
1313 Subdivisions (21) and (22) to read as follows:
1414 (21) "Gun show" means a place other than a permanent
1515 retail store, including a driveway, sidewalk or walkway, parking
1616 lot, or other parking area, or an event at which:
1717 (A) three or more individuals assemble to display
1818 firearms or firearm components to the public; and
1919 (B) a fee is charged for the privilege of
2020 displaying the firearms or firearm components or a fee is charged
2121 for admission to the area where the firearms or components are
2222 displayed.
2323 (22) "Gun show promoter" means a person who organizes,
2424 plans, promotes, or operates a gun show.
2525 SECTION 2. Chapter 46, Penal Code, is amended by adding
2626 Sections 46.065 and 46.066 to read as follows:
2727 Sec. 46.065. CERTAIN REQUIREMENTS RELATING TO SALES AT GUN
2828 SHOWS. (a) A person commits an offense if the person knowingly
2929 sells a firearm to another person in exchange for money or other
3030 consideration at a gun show without complying with the National
3131 Instant Criminal Background Check System in the manner required by
3232 18 U.S.C. Section 922 before completing the sale. A person who
3333 conducts a criminal background check as required by this subsection
3434 may charge a fee in an amount equal to the cost incurred by the
3535 person to obtain the background check.
3636 (b) A person commits an offense if the person knowingly
3737 sells a firearm to another person in exchange for money or other
3838 consideration at a gun show and the person does not maintain a
3939 record of the sale.
4040 (c) It is an exception to the application of Subsection (a)
4141 that the person to whom the firearm is sold is:
4242 (1) a peace officer; or
4343 (2) a person who is licensed to carry a handgun under
4444 Subchapter H, Chapter 411, Government Code.
4545 (d) An offense under this section is a Class A misdemeanor.
4646 Sec. 46.066. CERTAIN REQUIREMENTS RELATING TO GUN SHOW
4747 PROMOTER. (a) A gun show promoter commits an offense if the
4848 promoter, with criminal negligence, permits the sale of a firearm
4949 to a person at a gun show organized, planned, promoted, or operated
5050 by the promoter without complying with the National Instant
5151 Criminal Background Check System in the manner required by 18
5252 U.S.C. Section 922 before completion of the sale.
5353 (b) It is an exception to the application of Subsection (a)
5454 that the person to whom the firearm is sold is:
5555 (1) a peace officer; or
5656 (2) a person who is licensed to carry a handgun under
5757 Subchapter H, Chapter 411, Government Code.
5858 (c) Not later than the 30th day before the date on which a
5959 gun show is held, the gun show promoter shall provide written notice
6060 of the date, time, and place of the gun show to the local law
6161 enforcement agency of the county or municipality in which the gun
6262 show will be held.
6363 (d) A gun show promoter shall conduct, or arrange for a
6464 person who is a licensed firearms dealer under 18 U.S.C. Section 923
6565 to conduct, an instant criminal background check in the manner
6666 required by 18 U.S.C. Section 922 on any person who purchases a
6767 firearm at a gun show organized, planned, promoted, or operated by
6868 the promoter from another person who is not a licensed firearms
6969 dealer under 18 U.S.C. Section 923. A person who conducts a
7070 criminal background check as required by this subsection may charge
7171 a fee in an amount equal to the cost incurred by the person to obtain
7272 the background check.
7373 (e) A gun show promoter shall prominently post a notice in a
7474 form prescribed by the Department of Public Safety stating the
7575 requirements under this section and Section 46.065 relating to an
7676 instant criminal background check.
7777 (f) A gun show promoter commits an offense if the promoter
7878 violates Subsection (c), (d), or (e).
7979 (g) An offense under this section is a Class A misdemeanor.
8080 (h) If conduct constituting an offense under this section
8181 also constitutes an offense under Section 46.065, the actor may be
8282 prosecuted under either section or under both sections.
8383 SECTION 3. The change in law made by Section 46.066(c),
8484 Penal Code, as added by this Act, applies only to a gun show held on
8585 or after October 1, 2025.
8686 SECTION 4. This Act takes effect September 1, 2025.
