| 11 | 11 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 12 | 12 | | SECTION 1. Subchapter B, Chapter 2, Election Code, is |
|---|
| 13 | 13 | | amended by adding Section 2.0215 to read as follows: |
|---|
| 14 | 14 | | Sec. 2.0215. DETERMINATION OF MAJORITY VOTE. (a) In this |
|---|
| 15 | 15 | | section, "preferential voting system" means a voting system which |
|---|
| 16 | 16 | | permits a voter to rank each candidate through a numerical |
|---|
| 17 | 17 | | designation from the candidate the voter favors most to the |
|---|
| 18 | 18 | | candidate the voter favors least. |
|---|
| 19 | 19 | | (b) In an election requiring a majority vote to be elected |
|---|
| 20 | 20 | | to a public office, a candidate must receive more than half of the |
|---|
| 21 | 21 | | votes as originally cast. A majority may not be determined by using |
|---|
| 22 | 22 | | a preferential voting system to reassign votes. |
|---|
| 23 | 23 | | SECTION 2. Section 2.022(b), Election Code, is amended to |
|---|
| 24 | 24 | | read as follows: |
|---|
| 25 | 25 | | (b) Sections 2.0215, 2.023, 2.025, and 2.028 supersede a law |
|---|
| 26 | 26 | | outside this subchapter to the extent of any conflict. |
|---|
| 27 | 27 | | SECTION 3. This Act takes effect September 1, 2025. |
