77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to designating certain substances as Schedule IV
1010 controlled substances under the Texas Controlled Substances Act.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Section 481.037, Health and Safety Code, is
1313 amended to read as follows:
1414 Sec. 481.037. DESIGNATION OF CERTAIN SUBSTANCES
1515 [CARISOPRODOL]. Schedule IV includes:
1616 (1) carisoprodol;
1717 (2) mifepristone; and
1818 (3) misoprostol.
1919 SECTION 2. Section 481.111, Health and Safety Code, is
2020 amended by adding Subsection (g) to read as follows:
2121 (g) The provisions of this chapter relating to the
2222 possession of mifepristone and misoprostol do not apply to a
2323 pregnant woman who possesses mifepristone or misoprostol for her
2424 own consumption.
2525 SECTION 3. The change in law made by this Act applies only
2626 to an offense committed on or after the effective date of this Act.
2727 An offense committed before the effective date of this Act is
2828 governed by the law in effect on the date the offense was committed,
2929 and the former law is continued in effect for that purpose. For
3030 purposes of this section, an offense was committed before the
3131 effective date of this Act if any element of the offense occurred
3232 before that date.
3333 SECTION 4. This Act takes effect September 1, 2025.
