77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to the eligibility of certain students enrolled in a
1010 postsecondary educational institution for the supplemental
1111 nutrition assistance program.
1212 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1313 SECTION 1. Subchapter A, Chapter 33, Human Resources Code,
1414 is amended by adding Section 33.020 to read as follows:
1515 Sec. 33.020. SNAP ELIGIBILITY OF CERTAIN STUDENTS ENROLLED
1616 IN POSTSECONDARY EDUCATION PROGRAMS. (a) In this section,
1717 "postsecondary educational institution" includes:
1818 (1) an institution of higher education or a private or
1919 independent institution of higher education as defined by Section
2020 61.003, Education Code; and
2121 (2) a career school or college as defined by Section
2222 132.001, Education Code.
2323 (b) The commission shall, as authorized under 7 U.S.C.
2424 Section 2015(o)(6), provide an exemption from work requirements to
2525 provide supplemental nutrition assistance program benefits to an
2626 individual who is enrolled at least half-time as a student in a
2727 postsecondary educational institution and:
2828 (1) is eligible to participate in a state or federally
2929 funded work study program during the regular academic year, as
3030 determined by the postsecondary educational institution; or
3131 (2) in the current academic year, has an expected
3232 family contribution of $0, as determined in accordance with Part F,
3333 Title IV, of the Higher Education Act of 1965 (20 U.S.C. Section
3434 1087kk et seq.).
3535 (c) The executive commissioner shall adopt rules to
3636 implement this section, including rules that ensure a student
3737 remains eligible for supplemental nutrition assistance benefits
3838 during a break in the semester or academic term of the postsecondary
3939 educational institution in which the student is enrolled.
4040 SECTION 2. As soon as practicable after the effective date
4141 of this Act, the executive commissioner of the Health and Human
4242 Services Commission shall adopt the rules necessary to implement
4343 Section 33.020, Human Resources Code, as added by this Act.
4444 SECTION 3. Section 33.020, Human Resources Code, as added
4545 by this Act, applies only to an initial determination or
4646 recertification of eligibility for the supplemental nutrition
4747 assistance program under Chapter 33, Human Resources Code, that is
4848 made on or after the effective date of this Act. A determination or
4949 recertification made before the effective date of this Act is
5050 governed by the law in effect on the date the determination or
5151 recertification was made, and the former law is continued in effect
5252 for that purpose.
5353 SECTION 4. If before implementing any provision of this Act
5454 a state agency determines that a waiver or authorization from a
5555 federal agency is necessary for implementation of that provision,
5656 the agency affected by the provision shall request the waiver or
5757 authorization and may delay implementing that provision until the
5858 waiver or authorization is granted.
5959 SECTION 5. This Act takes effect September 1, 2025.
