| 11 | 11 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 12 | 12 | | SECTION 1. Subchapter B, Chapter 382, Health and Safety |
|---|
| 13 | 13 | | Code, is amended by adding Section 382.0162 to read as follows: |
|---|
| 14 | 14 | | Sec. 382.0162. MONITORING OF AIR CONTAMINANTS IN CERTAIN |
|---|
| 15 | 15 | | COUNTIES. (a) This section applies only to a county that: |
|---|
| 16 | 16 | | (1) is adjacent to a county with a population of 3.3 |
|---|
| 17 | 17 | | million or more; and |
|---|
| 18 | 18 | | (2) contains a coal-fired electric generating |
|---|
| 19 | 19 | | facility. |
|---|
| 20 | 20 | | (b) The commission shall install and maintain at least one |
|---|
| 21 | 21 | | air quality monitor in each county described by Subsection (a). The |
|---|
| 22 | 22 | | monitors required under this section must collect data on the air |
|---|
| 23 | 23 | | contaminants that are on the air pollutant watch list established |
|---|
| 24 | 24 | | under Section 382.0161. |
|---|
| 25 | 25 | | (c) At least one monitor must be located near each |
|---|
| 26 | 26 | | coal-fired electric generating facility located in each county |
|---|
| 27 | 27 | | described by Subsection (a). |
|---|
| 28 | 28 | | (d) The commission shall make available in real time on its |
|---|
| 29 | 29 | | Internet website data collected from a monitor required under this |
|---|
| 30 | 30 | | section. |
|---|
| 31 | 31 | | (e) The commission shall prepare and publish on its Internet |
|---|
| 32 | 32 | | website an annual report summarizing the data collected from the |
|---|
| 33 | 33 | | monitors required under this section. The report must: |
|---|
| 34 | 34 | | (1) analyze whether the data collected from each |
|---|
| 35 | 35 | | monitor exceeds the national ambient air quality standard |
|---|
| 36 | 36 | | established for an air contaminant; and |
|---|
| 37 | 37 | | (2) include recommendations for legislative or |
|---|
| 38 | 38 | | regulatory action to protect public health as it relates to air |
|---|
| 39 | 39 | | contaminants. |
|---|
| 40 | 40 | | SECTION 2. This Act takes effect September 1, 2025. |
