77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to monitoring air contaminant emissions in certain
1010 counties.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Subchapter B, Chapter 382, Health and Safety
1313 Code, is amended by adding Section 382.0162 to read as follows:
1414 Sec. 382.0162. MONITORING OF AIR CONTAMINANTS IN CERTAIN
1515 COUNTIES. (a) This section applies only to a county that:
1616 (1) is adjacent to a county with a population of 3.3
1717 million or more; and
1818 (2) contains a coal-fired electric generating
1919 facility.
2020 (b) The commission shall install and maintain at least one
2121 air quality monitor in each county described by Subsection (a). The
2222 monitors required under this section must collect data on the air
2323 contaminants that are on the air pollutant watch list established
2424 under Section 382.0161.
2525 (c) At least one monitor must be located near each
2626 coal-fired electric generating facility located in each county
2727 described by Subsection (a).
2828 (d) The commission shall make available in real time on its
2929 Internet website data collected from a monitor required under this
3030 section.
3131 (e) The commission shall prepare and publish on its Internet
3232 website an annual report summarizing the data collected from the
3333 monitors required under this section. The report must:
3434 (1) analyze whether the data collected from each
3535 monitor exceeds the national ambient air quality standard
3636 established for an air contaminant; and
3737 (2) include recommendations for legislative or
3838 regulatory action to protect public health as it relates to air
3939 contaminants.
4040 SECTION 2. This Act takes effect September 1, 2025.
