| 9 | 9 | | relating to credit toward a defendant's sentence for time confined |

| 11 | 11 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 12 | 12 | | SECTION 1. Section 2(a), Article 42.03, Code of Criminal |
|---|
| 13 | 13 | | Procedure, is amended to read as follows: |
|---|
| 14 | 14 | | (a) In all criminal cases the judge of the court in which the |
|---|
| 15 | 15 | | defendant is convicted shall give the defendant credit on the |
|---|
| 16 | 16 | | defendant's sentence for the time that the defendant has spent: |
|---|
| 17 | 17 | | (1) in jail for the case, including confinement served |
|---|
| 18 | 18 | | as described by Article 46B.009 and excluding confinement served as |
|---|
| 19 | 19 | | a condition of community supervision, from the time of the |
|---|
| 20 | 20 | | defendant's [his] arrest and confinement until the defendant's |
|---|
| 21 | 21 | | [his] sentence by the trial court; |
|---|
| 22 | 22 | | (2) in a substance abuse treatment facility operated |
|---|
| 23 | 23 | | by the Texas Department of Criminal Justice under Section 493.009, |
|---|
| 24 | 24 | | Government Code, or another court-ordered residential program or |
|---|
| 25 | 25 | | facility as a condition of deferred adjudication community |
|---|
| 26 | 26 | | supervision granted in the case if the defendant successfully |
|---|
| 27 | 27 | | completes the treatment program at that facility; [or] |
|---|
| 28 | 28 | | (3) confined in a mental health facility or |
|---|
| 29 | 29 | | residential care facility as described by Article 46B.009; or |
|---|
| 30 | 30 | | (4) confined in jail or prison for another case if that |
|---|
| 31 | 31 | | confinement occurred after the commission of the offense for which |
|---|
| 32 | 32 | | the defendant is convicted and before the date of the defendant's |
|---|
| 33 | 33 | | sentencing. |
|---|
| 34 | 34 | | SECTION 2. The change in law made by this Act applies to a |
|---|
| 35 | 35 | | defendant who is sentenced for an offense on or after the effective |
|---|
| 36 | 36 | | date of this Act, regardless of whether the offense is committed |
|---|
| 37 | 37 | | before, on, or after the effective date of this Act. |
|---|
| 38 | 38 | | SECTION 3. This Act takes effect September 1, 2025. |
