| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Subtitle F, Title 10, Government Code, is |
|---|
| 11 | 11 | | amended by adding Chapter 2278 to read as follows: |
|---|
| 12 | 12 | | Chapter 2278. Prohibition on Use of Taxpayer Resources |
|---|
| 13 | 13 | | Sec. 2278.001. DEFINITIONS. In this chapter: |
|---|
| 14 | 14 | | (1) "Gender reassignment" means a medical |
|---|
| 15 | 15 | | intervention, including surgery performed for the purpose of |
|---|
| 16 | 16 | | altering a person's primary or secondary sex characteristics or |
|---|
| 17 | 17 | | drugs or biologicals prescribed for the purpose of altering or |
|---|
| 18 | 18 | | maintaining alteration of a person's primary or secondary sex |
|---|
| 19 | 19 | | characteristics. |
|---|
| 20 | 20 | | (2) "Intersex person" means an person who: |
|---|
| 21 | 21 | | (A) has inborn chromosomal, gonadal, genital, or |
|---|
| 22 | 22 | | endocrine characteristics, or a combination of those |
|---|
| 23 | 23 | | characteristics, that are not suited to the typical definition of |
|---|
| 24 | 24 | | male or female or are atypical for the determined sex of the person; |
|---|
| 25 | 25 | | or |
|---|
| 26 | 26 | | (B) is considered by a medical professional to |
|---|
| 27 | 27 | | have inborn chromosomal, gonadal, genital, or endocrine |
|---|
| 28 | 28 | | characteristics that are ambiguous or atypical for the determined |
|---|
| 29 | 29 | | sex of the person. |
|---|
| 30 | 30 | | Sec. 2278.002. PROHIBITION ON USE OF TAXPAYER RESOURCES FOR |
|---|
| 31 | 31 | | GENDER REASSIGNMENT. (a) No funds authorized or appropriated by |
|---|
| 32 | 32 | | State law shall be expended for any gender reassignment. |
|---|
| 33 | 33 | | (b) No funds authorized or appropriated by State law shall |
|---|
| 34 | 34 | | be expended for health benefits that covers gender reassignment. |
|---|
| 35 | 35 | | (c) The prohibition in subsection (a) and (b) does not apply |
|---|
| 36 | 36 | | to gender reassignment to be performed on an intersex person. |
|---|
| 37 | 37 | | SECTION 2. This Act takes effect immediately if it receives |
|---|
| 38 | 38 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 39 | 39 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 40 | 40 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 41 | 41 | | Act takes effect September 1, 2025. |
