88 relating to a prohibition on funding for gender reassignment.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subtitle F, Title 10, Government Code, is
1111 amended by adding Chapter 2278 to read as follows:
1212 Chapter 2278. Prohibition on Use of Taxpayer Resources
1313 Sec. 2278.001. DEFINITIONS. In this chapter:
1414 (1) "Gender reassignment" means a medical
1515 intervention, including surgery performed for the purpose of
1616 altering a person's primary or secondary sex characteristics or
1717 drugs or biologicals prescribed for the purpose of altering or
1818 maintaining alteration of a person's primary or secondary sex
1919 characteristics.
2020 (2) "Intersex person" means an person who:
2121 (A) has inborn chromosomal, gonadal, genital, or
2222 endocrine characteristics, or a combination of those
2323 characteristics, that are not suited to the typical definition of
2424 male or female or are atypical for the determined sex of the person;
2525 or
2626 (B) is considered by a medical professional to
2727 have inborn chromosomal, gonadal, genital, or endocrine
2828 characteristics that are ambiguous or atypical for the determined
2929 sex of the person.
3030 Sec. 2278.002. PROHIBITION ON USE OF TAXPAYER RESOURCES FOR
3131 GENDER REASSIGNMENT. (a) No funds authorized or appropriated by
3232 State law shall be expended for any gender reassignment.
3333 (b) No funds authorized or appropriated by State law shall
3434 be expended for health benefits that covers gender reassignment.
3535 (c) The prohibition in subsection (a) and (b) does not apply
3636 to gender reassignment to be performed on an intersex person.
3737 SECTION 2. This Act takes effect immediately if it receives
3838 a vote of two-thirds of all the members elected to each house, as
3939 provided by Section 39, Article III, Texas Constitution. If this
4040 Act does not receive the vote necessary for immediate effect, this
4141 Act takes effect September 1, 2025.
