| 11 | 11 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 12 | 12 | | SECTION 1. Chapter 112, Occupations Code, is amended by |
|---|
| 13 | 13 | | adding Subchapter C to read as follows: |
|---|
| 14 | 14 | | SUBCHAPTER C. COMPLAINT REFERRALS |
|---|
| 15 | 15 | | Sec. 112.101. COMPLAINTS AGAINST HEALTH CARE PRACTITIONER |
|---|
| 16 | 16 | | LICENSED BY DIFFERENT LICENSING ENTITY. (a) Notwithstanding any |
|---|
| 17 | 17 | | other law, a licensing entity that receives a complaint concerning |
|---|
| 18 | 18 | | a health care practitioner who holds a license issued by a different |
|---|
| 19 | 19 | | licensing entity shall promptly forward a copy of the complaint to |
|---|
| 20 | 20 | | that licensing entity. |
|---|
| 21 | 21 | | (b) A licensing entity may not take disciplinary action |
|---|
| 22 | 22 | | based on a complaint against a health care practitioner who holds a |
|---|
| 23 | 23 | | license issued by a different licensing entity unless that |
|---|
| 24 | 24 | | licensing entity refers the complaint back to the licensing entity |
|---|
| 25 | 25 | | that received the complaint for investigation and resolution. |
|---|
| 26 | 26 | | SECTION 2. The changes in law made by this Act apply only to |
|---|
| 27 | 27 | | a complaint filed against a health care practitioner on or after the |
|---|
| 28 | 28 | | effective date of this Act. A complaint filed before the effective |
|---|
| 29 | 29 | | date of this Act is governed by the law in effect on the date the |
|---|
| 30 | 30 | | complaint was filed, and the former law is continued in effect for |
|---|
| 31 | 31 | | that purpose. |
|---|
| 32 | 32 | | SECTION 3. This Act takes effect immediately if it receives |
|---|
| 33 | 33 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 34 | 34 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 35 | 35 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 36 | 36 | | Act takes effect September 1, 2025. |
